Proposed Methodology for Pricing Land according to the 2024 Land Law

The Ministry of Natural Resources and Environment has finalized the draft decrees regarding the implementation of the Land Law 2024, which will come into effect on January 1, 2025. Among these draft decrees is the one that regulates land prices. Feedback on these draft decrees is now being sought.

4 land valuation methods

Regarding land valuation methods, the draft defines the selection of land valuation methods. Information to apply land valuation methods, the responsibility of valuation consulting organizations when collecting information, the responsibility of units in providing information.

Information about land prices, land rental prices, ground rental prices to apply the comparison method, surplus method, and develop land price adjustment coefficients is information within a period not exceeding 24 months from the time of land valuation backwards, collected in the national database of land information, national database of prices or other sources.

When applying comparison methods, surplus methods must prioritize the selection of land plots to be compared in order.

Similarity in location, infrastructure conditions, area, size, shape, land use coefficients, construction density, building height, and other factors affecting land prices compared to the land plot to be valued.

Annual land price list disclosure



Regarding land price lists, the draft stipulates grounds for construction, adjustment, amendment, and supplementation of land price lists; procedures for construction, adjustment, amendment, and supplementation of annual land price lists; adjustment, amendment, and supplementation of land price lists in the year of applying land price lists.

The Department of Natural Resources and Environment is responsible for preparing projects to construct, adjust, amend, and supplement land price lists and submit them to the provincial People’s Council for approval before June 1 of the construction year, adjustment, amendment, and supplement of land price lists.

The provincial People’s Council approves projects to construct, adjust, amend, and supplement land price lists before June 15 of the construction year, adjustment, amendment, and supplementation of land price lists.

The People’s Council at provincial level directs the provincial People’s Committee to complete the land price list for issuance, disclosure, and application on January 1 every year and update it in the national database of land information.

In the Land Law 2024, it is stipulated that annualy, the provincial People’s Committee is responsible for submitting to the provincial People’s Council for decision on the adjustment, amendment, and supplementation of land price lists for public announcement and application from January 1 of the following year.

In case the land price lists need to be adjusted, amended, and supplemented during the year, the provincial People’s Committee is responsible for submitting to the provincial People’s Council for decision.

In addition, the draft decree stipulates the appraisal of land price lists including the establishment of an appraisal board, principles of operation, responsibilities, powers of the chairman of the board, members of the board, and the permanent agency.

With the land price list built based on the land position, the draft stipulates how to determine the land position; survey, collect information on market land prices; construct land prices in the land price list by the land position.
