The Illicit Lake Excavation: Uncovering the Truth Behind the Unauthorized Digging at the Thanh Ha Urban Area

The local authorities have ordered the investor of the Thanh Ha Cienco 5 urban area in Hanoi to refill a excavated lake with an area of approximately 9,000 sqm on a green space-designated land in zone B3.1, with a deadline set for June 15, 2024. However, as of now, the refilling process has been slow and lackluster, with no end in sight.

Observations by PV on July 9 revealed a slow and perfunctory restoration of the land by the investor, who had filled in a lake on green space in Zone B3.1 of the Thanh Ha Cienco 5 Urban Area in Cu Khe Commune, Thanh Oai District, Hanoi. Only one excavator was observed conducting land filling operations.

Despite having exceeded the deadline set by the People’s Committee of Cu Khe Commune (completed before June 15), the investor has only managed to fill a small area, leaving behind deep pits on a large scale, posing potential safety hazards.

The investor’s slow progress in restoring the land by filling the lake that was dug without proper planning.

Speaking to Tien Phong, Mr. Vu Quoc Tri, Vice Chairman of the People’s Committee of Cu Khe Commune, Thanh Oai District, stated that the investor of the Thanh Ha Cienco 5 Urban Area is in the process of filling the previously dug lake to make way for green space in accordance with the approved planning. The local authorities are urging the investor to expedite the process and ensure that the entire lake area in Zone B3.1 is restored according to the approved planning.

Meanwhile, the leadership of the Urban Management Division of Thanh Oai District stated that they will advise the People’s Committee of the district to request the investor to continue filling the lake area in Zone B3.1.

As previously reported by Tien Phong, residents of the Thanh Ha A and B – Cienco 5 Urban Area had complained that in Zone B3.1 of the urban area, which falls under the jurisdiction of Cu Khe Commune, Thanh Oai District, Hanoi, the investor, Cienco 5 Land Development Joint Stock Company, had excavated land designated for green space and dug a lake that was not part of the planning. Moreover, the sand extracted from the lake was loaded onto trucks and transported out of the construction site.

Regarding this issue, the People’s Committee of Cu Khe Commune stated that in April 2024, they inspected and discovered that the investor of the Thanh Ha Cienco 5 project was constructing and digging a lake in Zone B3.1, which is designated as green space in the planning. On April 5, the Commune People’s Committee issued Document No. 97 requesting the investor to temporarily suspend the construction. However, the investor continued with the construction and lake excavation despite the “red card” from the Commune People’s Committee.

On June 7, the People’s Committee of Cu Khe Commune sent another document to Cienco 5 Land Development Joint Stock Company regarding the remediation of the lake excavation in Zone B3.1. Upon inspection, it was found that the investor had excavated a lake with an area of approximately 9,000 square meters. The lake was about 2 meters deep compared to the original ground level, and the company had erected stakes and ropes around the lake and was in the process of planting trees.

“To ensure that the project is implemented in accordance with the approved planning, the People’s Committee of Cu Khe Commune requests the investor to stop construction and urgently remediate the entire lake area in Zone B3.1 according to the approved planning. The deadline for completion is before June 15, 2024,” the document from the People’s Committee of Cu Khe Commune stated.

Slow progress in handling construction order violations

During the implementation of the Thanh Ha Cienco 5 Urban Area project, the investor has committed multiple violations of construction orders, including the construction of several items that deviated from the approved planning, which were identified by the competent authorities. These include the mixed-use building in lots B1.1-CHC01 – B1.1-CHC03, B1.3-HH03, B1.4-HH01, B1.4-HH02, B2.1-HH01, B2.1-HH02; structures built by secondary investors and residents; temporary warehouses and workshops that were converted into commercial and service facilities; and the temporary headquarters of the company built on green space, among others. There were also construction violations in Zones A3.1 and B2.1, including a 6-story building with 1 basement and a construction area of 500 square meters, 10 terraced houses, 4 villas, and 1 low-rise building. However, the handling of construction order violations in the Thanh Ha A and B – Cienco 5 Urban Area has been slow. The Hanoi People’s Committee recently assigned the Department of Construction to coordinate with the Department of Planning and Architecture, the Department of Natural Resources and Environment, and the People’s Committees of Ha Dong and Thanh Oai districts to inspect, review, and resolve construction order violations in the Thanh Ha Cienco 5 Urban Area…
