The Ho Chi Minh City Department of Natural Resources and Environment has submitted a proposal to the People’s Committee regarding compensation, support, and resettlement policies for a land recovery and canal-side housing relocation project.

Specifically, for land with a source in rivers, canals, streams, and specialized water bodies that have been encroached upon and had their land use purpose changed without authorization, there will be no compensation provided. However, support for land will be calculated and offered.

In cases where the land was used before July 1, 2014, 70% of the land compensation price will be supported. If the land was used on or after July 1, 2014, no land support will be calculated. The area of land eligible for support is the portion with houses, structures, and architectural works.

For areas of land that do not originate from rivers, canals, streams, or specialized water bodies, compensation, support, and resettlement will be calculated and provided in accordance with the regulations in place at the time of approval of the compensation, support, and resettlement plan.

According to the Department of Natural Resources and Environment, regarding the minimum resettlement quota support, the People’s Committees of districts, Thu Duc City, and Ho Chi Minh City are based on the 2024 Land Law to resolve resettlement for households. In cases where the entire residence and land are eligible for compensation regarding residential land, they will be provided with social housing or land plots.

If the residence is recovered but does not meet the conditions for compensation regarding residential land, and if the area of recovered residential land is greater than or equal to the land allocation limit in the locality, the household will be provided with social housing or a land plot. If the area is smaller, they will be offered social housing.

For cases where resettlement is resolved but the compensation and support for residential land are insufficient compared to the value of a minimum resettlement quota, the state will provide support to ensure the household receives a minimum resettlement quota (in the form of money, land, or housing).

If the total value of compensation and support for housing and land that the household receives is insufficient to pay for the value of housing in the resettlement area, the project’s Compensation, Support, and Resettlement Council will consider allowing the household to pay in installments.

In cases of resettlement through land plots, the household will pay the total amount of compensation and support for the land they have received. The difference between the value of the land plot allocated to the household and the amount they initially paid will be recorded as land use debt in accordance with regulations.

For resettlement through apartment units, the household will pay the total amount of compensation and support for the housing and land they have received. The difference between the value of the allocated apartment and the initial payment will be paid in monthly installments over a maximum of 15 years, calculated based on the average non-term deposit interest rate of four state-owned commercial banks (BIDV, Agribank, VietinBank, and Vietcombank) on the outstanding debt balance.

The Department of Natural Resources and Environment states that if approved by the Ho Chi Minh City People’s Committee, these policies will be applied to projects implementing compensation, support, and resettlement in accordance with the 2024 Land Law.

The Department will incorporate these policies into the decision of the Ho Chi Minh City People’s Committee regarding regulations on compensation, support, and resettlement when the state recovers land in the city (replacing Decision No. 28).

The Department also proposes to immediately apply these new policies to the Rach Xuyen Tam Project (from Nhieu Loc – Thi Nghe Canal to Vam Thuat River) in Binh Thanh and Go Vap districts, affecting approximately 2,300 households.
