In the period of 2023-2025, Ho Chi Minh City People’s Committee has recently issued a report on the plan for Land Management and Effective Land Use in the city.

Tight management

According to the assessment of Ho Chi Minh City People’s Committee, during the implementation of the plan for Land Management and Effective Land Use in the city, the coordination among departments, agencies, People’s Committees of districts, Thu Duc City has been relatively good. However, the progress is still slow in some areas.

The plan consists of 6 main issue groups including urban planning and land use plans; assessing the effectiveness of land management and use; land finance; management of state-owned assets such as houses and land; land administration; operation mechanism of land development fund center.

For the implementation plan in the period of 2023-2025, Ho Chi Minh City People’s Committee emphasized the continued implementation of key programs in the 2020-2025 term of the 11th City Party Congress in implementing this plan. Specifically, there should be prioritized plans to determine feasible progress in land management for each year.

To improve land use efficiency, the Department of Natural Resources and Environment is assigned to coordinate with People’s Committees of districts, Thu Duc City to inspect and monitor the progress of annual land use plans after city approval. At the same time, find solutions to promote and remove obstacles to achieve at least 80% of the registered land use targets. The department is also responsible for proposing the evaluation of the effectiveness of land management and use through land accessibility index.

In terms of administrative work, the Department of Natural Resources and Environment coordinates with the Department of Information and Communications, Department of Justice to build a data system on real estate transactions, transaction values… as a basis for state management agencies to check, cross-check and update information to the land information system. In addition, it focuses on many tasks to complete a comprehensive and unified land database.

In terms of land prices, the Department of Finance is studying methods to calculate land price adjustment coefficients to determine specific land prices annually, in which the coefficients should not be subjectively determined by authorized individuals.

Efficient use of land resources will contribute to the strong development of Ho Chi Minh City

Well-exploited state-owned properties

According to the report of Ho Chi Minh City People’s Committee, 60 agencies, organizations, units, and businesses have reported on the rearrangement and handling of houses and land in accordance with Decree 167/2017, and at the same time, seeking approval from the Chairman of the Steering Committee for Decree 167 for the arrangement and handling plan for 363 addresses of 22 agencies and units. Specifically, 25 addresses of houses and land owned by agencies and units with no demand for use have been recovered.

In the coming time, the Department of Finance (Permanent Secretariat of the Steering Committee for Decree 167) will be responsible for inspecting and reviewing houses and land managed by agencies, units, organizations, and enterprises in the city according to Decree 167/2017 and Decree 67/2021 on the arrangement and handling of state assets. Based on that, they will propose rearrangement and handling plans according to regulations and summarize and report to the Steering Committee for consideration and decision by Ho Chi Minh City People’s Committee.

Houses and land that are used for the wrong purpose and inefficiently will be reported to Ho Chi Minh City People’s Committee and Ministry of Finance for consideration of recovery or auction to create revenue for the city budget or for the needs of the city.

Regarding state-owned land funds, according to Mr. Huynh Thanh Kiet, Deputy Director of Ho Chi Minh City Department of Construction, the Center for Housing Management and Construction Appraisal (under Ho Chi Minh City Department of Construction) is currently managing 44 addresses of state-owned houses and land according to Decree 167/2017. In reality, there are more than 1,800 addresses in the city falling into this category. The Department of Construction will receive this huge land fund, but the next management issue needs to be supplemented with regulations to facilitate management and exploitation. Accordingly, the Department of Construction proposes that Ho Chi Minh City People’s Committee provide opinions to the Government on amending and supplementing the Asset Auction Law, including adding regulations on auctioning out properties for lease.

The Department of Construction also recommends that Ho Chi Minh City People’s Committee direct the sequence of procedures and authority to issue auction decisions to expedite the auction of the land fund that no longer needs to be used and has had the auction policy approved by Ho Chi Minh City People’s Committee. According to the Department of Construction, the city has approved the auction of about 4,800 properties, but there is currently no auction process for the land fund. This needs to be done soon to recover the budget.

Creating investment land funds

Regarding the operation mechanism of the Land Development Fund Center, the Department of Natural Resources and Environment is assigned to take charge of building regulations and coordination mechanisms in implementing land fund creation on the city’s territory for urban development models towards developing TOD public transportation.

The Department of Planning and Architecture coordinates with relevant departments to establish an inter-departmental working group to review planning. The working group will propose the area for recovery and land fund creation for the auxiliary area of ​​the railway station on the authorized and intersections along the Belt Road 3. It is expected to be completed in the second quarter of 2024.
