Inspection requires Park City project to provide documents

The Hanoi Inspectorate has recently requested the Hanoi Department of Construction and the Hanoi Department of Finance to report, provide documents, and related materials regarding the implementation of the New Urban Area Project on Le Trong Tan Street (commercially known as Park City), which is being developed by Vietnam International Urban Development Corporation (VIDC).

This is being done according to Plan No. 5737/KH-TTTTP dated November 14, 2023 by the Hanoi Inspectorate for the implementation of Plan No. 320/KH-UBND dated October 5, 2023 by the Hanoi People’s Committee related to the implementation of the conclusions of the Central Steering Committee on Anti-Corruption and Anti-Negative Acts on the results of examinations of leadership, direction, organization of the detection, handover, acceptance, settlement of denunciations and reports on crimes, and proposals to initiate cases with signs of corrupt, economic, and negative crimes.

Among them is the reviewing of compliance with regulations on the management and use of state-owned assets and land management at the Park City project, of which VIDC is the investor.

On January 9, 2024, the Hanoi Inspectorate issued Document No. 148/TTTP-P6 and No. 148/TTTP-P6, requesting the Department of Finance and the Department of Construction to report in writing and provide the Park City project documents by no later than January 16, 2024.

However, as of February 5, 2024, the Hanoi Inspectorate has not yet received the reports and documents from the Department of Finance and the Department of Construction. Therefore, the Hanoi Inspectorate continues to urge the Department of Construction and the Department of Finance to urgently report and provide documents and materials related to the project through Document No. 594/TTTP-P6.

It is known that the Park City project is located within the administrative boundaries of La Khe and Yen Nghia wards, Ha Dong district, Hanoi; previously, it was in Yen Nghia commune and La Khe ward, Hanoi Ha Dong City, Hanoi province (former).

The project covers an area of approximately 77.4 hectares, with a planned population of about 23,000 people.

In 2015, the Hanoi People’s Committee issued Resolution No. 6077/QD-UBND approving the adjustment of the detailed overall plan of the Park City project. It is noteworthy that the 1/500-scale planning of the Park City project did not allocate 20% of the land fund for social housing construction.

It is known that the Park City project is also in the process of determining financial obligations.

Prior to that, in July 2008, the former Hanoi Provincial People’s Committee issued Decision No. 2926/QD-UBND approving the land use payment of the Park City project. However, in December 2016, the Hanoi Department of Natural Resources and Environment only handed over the project’s boundary milestones to VIDC.

According to the Hanoi Department of Natural Resources and Environment, the determination of financial obligations in July 2008 while the project had not yet cleared the site was not in line with regulations.

The Department of Natural Resources and Environment cited 3 legal bases for determining financial obligations for the Park City project. They are Section B, Clause 1, Article 4 of Decree No. 84/2007/ND-CP dated May 25, 2007 by the Government; Section B, Clause 1, Article 20 of Decree No. 45/2014/ND-CP dated May 15, 2014 by the Government; and Clause 3, Article 108 of the Land Law 2013.

Therefore, the Department of Natural Resources and Environment has requested the Hanoi People’s Committee to allow for the supplementary determination of financial obligations (if any) due to the adjustment of the planning; review and determine land use payments at the actual handover time in December 2016 – the time of completion of land clearance and acceptance of land outside the actual site according to regulations.

According to reports, besides the areas reserved for villa, townhouse, and apartment construction, some areas of the Park City project are still enclosed and vacant.
