Land Law Dissemination and Advocacy: A Paramount Endeavor

In the afternoon of May 4th, speaking at the regular Government press conference, Deputy Minister of Natural Resources and Environment Le Minh Ngan said that after the Land Law was passed by the National Assembly on January 18th, 2024, in order to soon develop land resources to serve socio-economic development, ensure national defense and security, protect the environment, and achieve sustainable development, bringing land policies into practice soon, the Prime Minister directed the Ministry of Natural Resources and Environment (MONRE), relevant ministries, and sectors to urgently prepare the necessary conditions to submit to the National Assembly for permission for the Land Law to take effect early on July 1st, 2024.

Implementing the Prime Minister’s direction, Ministries, and sectors such as the MONRE, Ministry of Finance, Ministry of Agriculture and Rural Development, Ministry of Labor-Invalids and Social Affairs, Ministry of Home Affairs, local authorities at all levels, and the Ministry of Justice have urgently mobilized resources in a short time, with very urgent progress and very high quality requirements, and a large amount of work to implement the development of documents regulating and guiding the implementation of the Land Law. These documents include Decrees, Circulars, then decisions, regulations under the authority of local authorities.

Specifically, for the MONRE, up to now, it has been assigned to draft 6 decrees and 4 circulars, and has now completed the drafts. Currently, the Ministry of Justice has conducted the appraisal and expects that before May 10th, 2024, the MONRE will submit to the Government the guiding decrees in accordance with the direction of the Prime Minister and Deputy Prime Minister Tran Hong Ha.

The Ministry of Finance, Ministry of Agriculture and Rural Development, Ministry of Labor-Invalids and Social Affairs, Ministry of Home Affairs, and localities are also urgently finalizing the contents of the work within their responsibility and authority, to submit to the Government or issue according to their authority, ensuring sufficient conditions to report to the Government for the Government to submit to the National Assembly, proposing that the National Assembly allow the Land Law to take effect on July 1st, 2024.

In addition, the MONRE is also assigned to consult with the Government on the draft Resolution of the National Assembly on the Land Law taking effect from July 1st, 2024. The MONRE has completed the procedures, reported to the Government, and sent to the Ministry of Justice for appraisal.

“We plan to submit to the Government as soon as possible to ensure consistency between the Resolution, the draft Resolution of the National Assembly, and the guiding documents for implementation, ensuring the conditions for drafting documents,” said Mr. Ngan.

In addition, to bring the Land Law into effect soon, the propaganda and dissemination of the Law are also extremely important. In the recent past, the Prime Minister has directed and assigned the MONRE to organize the Land Law implementation Conference nationwide, ranging from the Standing Committee of the Provincial Party Committee, the People’s Council, the People’s Committee, to specialized cadres.

The Ministry of Justice has coordinated with the MONRE to organize a National Conference in the judicial sector; The Central Propaganda Department has also organized a Conference for national reporters to coordinate with the MONRE. Recently, the MONRE has also coordinated with localities to organize conferences to disseminate the 2024 Land Law, with some conferences having thousands of participants both in person and online. In the coming time, the MONRE will actively coordinate with localities to continue the dissemination.

In addition, the MONRE also coordinates with news agencies and other media agencies to focus on providing information about the new policies of the Land Law so that people, businesses, land users, and interested parties can grasp it in a timely manner, so that when the Land Law comes into effect, together with legal documents, awareness of the new Land Law will create a synchronous legal framework in bringing the 2024 Land Law into practice in accordance with the Party’s policy in Resolution 18.

The Deputy Minister said that in terms of expectations, the 2024 Land Law institutionalizes the Party’s policies, focusing on Resolution 18 on land policies. In addition to specialized contents such as planning, land use plans, land recovery, compensation, support, resettlement, land allocation, land leasing, conversion of land use purposes, land prices, land finance, land registration, issuance of land use right certificates, property ownership rights attached to land, and then building a land database, etc…

The 2024 Land Law has been developed based on the principle of promoting decentralization, delegating authority, reforming administrative procedures, reducing intermediary steps, reducing compliance costs, and enhancing responsibility and proactiveness for local authorities. This will help to resolve some difficulties and obstacles identified in the summary of the 2013 Land Law.

At the same time, it will shorten the time and cost of releasing land resources for socio-economic development, ensuring national defense and security, protecting the environment, and sustainable development of the country, including the land use right market and real estate market as stated in the Government’s report.
