New Land Law 2024: New Land and House Ownership Certificates to Feature QR Codes

The Ministry of Natural Resources and Environment is drafting a Circular regulating the Land Use Rights, Property Rights attached to Land and Land Records Certificate.

The draft states that the Land Use Rights Certificate (pink book, red book), property rights attached to land (Certificate) are issued by the Ministry of Natural Resources and Environment in a unified form and are applied nationwide to all types of land and other properties attached to land.

The Certificate consists of one sheet with 02 pages, printed with a background of pink lotus flower pattern (called the Certificate form), with a size of 210 x 297 mm; including the following contents according to the regulations:

Page 1 of the Certificate includes the following contents:

– National Emblem;

– National Coat of Arms;

– QR code;

– The name “Land Use Rights Certificate, Property Rights attached to Land” printed in red;

– Section “1. Land user, house owner and property attached to land”;

– Section “2. Information of the land plot”;

– Section “3. Information of the property attached to the land”;

– Section “4. Note”;

– Section “5. Land plot diagram”;

– Place name, date of signing the Certificate, and the issuing agency at the bottom right corner of Page 1 of the Certificate;

– Contents to be noted for the grantee of the Certificate.

Page 2 of the Certificate includes the following contents:

– Section “6. Changes after granting the Certificate:”;

– Number of the Certificate issuance book.

Information about the grantee of red book, pink book will be accompanied by the identity card number, citizen identification number, but from January 1, 2025, the identity card information will not be used according to the regulations of the Law on Citizen Identification.

Vietnamese people residing abroad according to the provisions of the law on nationality are entitled to own houses in Vietnam, foreign individuals are entitled to own houses according to the regulations, then write “Mr.” (or “Ms.”), then write full name, year of birth, nationality, personal papers stating “Passport number: …, place of issue: …, year of issue: …”; permanent residence address of that person in Vietnam, if any.

According to the Circular, the Registration and Land Information Data Department is responsible for developing regulations on anti-counterfeiting factors (security features) on the Certificate form; organizing the printing and issuing of Certificate forms to competent land management agencies and Land Registration Offices in localities; Establishing and managing a book to track the issuance of Certificate forms; c) Inspecting and guiding the management and use of Certificate forms in localities.

The Department of Natural Resources and Environment is responsible for making plan of using Certificate form from locality to send to the Registration and Land Information Data Department before October 31 of each year. 

Inspect and guide the management and use of the Certificate form in the locality. Organize the destruction of Certificate forms, printed or written Certificates that are damaged according to the provisions of law on record-keeping.

Periodically report on the situation of receiving, managing, and using Certificate form from locality to the Registration and Land Information Data Department before December 25 of each year.

The Land Registration Office and the Department of Natural Resources and Environment are responsible for reporting to the Department of Natural Resources and Environment about the demand for using Certificate forms before October 20 of each year. 

At the same time, receive, manage, establish a monitoring book to receive, distribute, and use Certificate forms. Regularly inspect the management and use of Certificate forms to ensure consistency between the monitoring book and actual Certificate forms being managed and used. 

In addition, collect and manage damaged Certificate forms, printed or written Certificates and send them to the Department of Natural Resources and Environment for destruction.

Report on the status of receiving, managing and using Certificate form to the Department of Natural Resources and Environment every 6 months before June 20, every year before December 20 of each year.

After collecting opinions from the public and relevant ministries and localities in May, the Ministry of Natural Resources and Environment will issue a circular.
