Why was the former provincial chairman prosecuted and provisionally detained?

Former Binh Thuan Province Chairman Nguyen Tien Phuong to be held responsible for signing illegal documents relating to land and investment

According to Cong An Nhan Dan, Former Binh Thuan Province People’s Committee Chairman Le Tien Phuong (2011-2016) and the accused: Xa Duong Thang and Nguyen Xuan Phong, were prosecuted and detained by the Ministry of Public Security Investigation Agency for their involvement in a “Violation of regulations on management and use of state assets, causing waste and loss” that arose at the Phan Thiet Coastal Tourist Urban Area project led by Rang Dong Group as the main investor.

The Former Binh Thuan Province People’s Committee Chairman has been disciplined by the Politburo with the removal from all positions in the Party and had his former position as Binh Thuan Province People’s Committee Chairman for two terms revoked by the Prime Minister due to serious violations and shortcomings at work.

Thereof, Mr. Le Tien Phuong bears responsibility for violations and shortcomings of the Binh Thuan Provincial Party Committee Standing Committee for the 2010-2015 term; is primarily responsible as the head of the Provincial Party Committee Secretariat of the Binh Thuan Province People’s Committee and Provincial People’s Committee for the 2011-2016 term; and bears direct responsibility and personal responsibility for signing documents that violated the law on land, investment, and housing (relating to the Phan Thiet Coastal Tourist Urban Area project).

The Phan Thiet Coastal Tourist Urban Area project is one of nine projects that the Ministry of Public Security investigated according to the criminal denunciation of Binh Thuan citizens.

The violations and shortcomings of the Binh Thuan Provincial Party Committee Standing Committee, including Mr. Le Tien Phuong, have caused serious consequences, great losses of money and state assets, and public outrage, giving rise to many petitions, accusations, and complaints, negatively affecting the prestige of the local Party Committee and government.

Mr. Le Tien Phuong was the one who signed the decision, approved the detailed plan for construction of the Phan Thiet Coastal Tourist Urban Area (Phu Thuy Ward), where Rang Dong Group acted as the main investor, as well as other important decisions concerning the project.

The decision allowed the investor (then Golf and Phan Thiet Golf Club Co., Ltd., a member of Rang Dong Group) to develop the urban area and combine residential, commercial and service land. The total approved area for this urban area was over 62 hectares.

After identifying signs of a crime of “Violation of regulations on management and use of state assets causing waste and loss,” the Ministry of Public Security Investigation Agency decided to initiate criminal proceedings to investigate the signs of violations at the Phan Thiet Coastal Tourist Urban Area project.

After initiating criminal proceedings, prosecuting the accused, and temporarily detaining them, on the afternoon of April 26, the Ministry of Public Security Investigation Agency and representatives of the People’s Procuracy executed a search warrant at Mr. Le Tien Phuong’s private residence on Nguyen Tuong Street, Phu Thuy Ward, Phan Thiet City, as well as at the residences of other accused, including Nguyen Xuan Phong (Former Deputy Director of Binh Thuan Tax Department) on Hung Vuong Street, Phan Thiet City, and Xa Duong Thang (Former Director of Binh Thuan Province Department of Construction) on Tuyên Quang Street, Phan Thiet City.

Former provincial chairman, former director of the construction department, and former city chairman are facing prosecution and detention

Related to the incident, on April 23, the Ministry of Public Security Investigation Agency made the decision to prosecute the accused and made criminal procedural decisions against 12 individuals for the crime of “Violating regulations on the management and use of state assets causing waste and loss.” Thereof, the Ministry of Public Security Investigation Agency made the decision to prosecute the accused and issue an arrest warrant to detain 5 individuals, including: Le Tien Phuong, Former Chairman of Binh Thuan Province People’s Committee; Xa Duong Thang, Former Director of the Department of Construction, Former Secretary of Bac Binh District Party Committee, Binh Thuan Province; Do Ngoc Diep, Former Chairman of Phan Thiet City People’s Committee; Ho Nhu Hai, Former Deputy Director of the Southern Information and Valuation Joint Stock Company – Binh Thuan Branch, Price Assessor, and Le Anh Huy, Former Head of the Administrative Division of the Binh Thuan Provincial Land Management Department.

At the same time, the Investigation Agency also issued a decision to prosecute the accused and order Nguyen Xuan Phong, Former Deputy Director of Binh Thuan Provincial Tax Department, to refrain from leaving his place of residence.

Search warrants were issued for the residences of 6 accused, including: Le Tien Phuong, Xa Duong Thang, Do Ngoc Diep; Ho Nhu Hai; Le Anh Huy; Nguyen Xuan Phong.

It is known that out of the 12 prosecuted individuals, 6 are currently serving sentences in prison for the crime of “violating regulations on the management and use of state assets, causing waste and loss,” and “serious lack of responsibility” in the project of Tan Viet Phat 2 Commercial Service and Residential Area, Binh Thuan Province.
