The Deputy Prime Minister emphasized that this is a very challenging and complex issue, but it is of utmost importance in unlocking a significant source of capital for the state, businesses, and citizens to serve socio-economic development.
The violations in projects and land management mentioned in inspection and audit conclusions and court rulings in some provinces and cities are related to historical factors, changes in policies and laws over time, and shortcomings in state management. Many of these violations cannot be rectified without specific mechanisms and policies.
Addressing these challenges and removing obstacles in projects and land management with violations, as directed by the Politburo, is essential to resolving similar cases nationwide, the Deputy Prime Minister noted.
The delegates provided feedback on the draft implementation plan, the reorganization of the working group, and the tasks assigned to each ministry, sector, and locality according to the Politburo’s conclusion.
Asserting that Ho Chi Minh City will complete the assigned tasks as planned, Chairman of the Ho Chi Minh City People’s Committee Phan Van Mai proposed that the Government soon issue a decree amending multiple decrees, and the National Assembly pass a resolution on specific mechanisms and policies for projects and land with violations, following the Politburo’s instructions. He also suggested that inspection, prosecution, and judiciary agencies promptly issue conclusions for specific projects.
Concluding the meeting, the Deputy Prime Minister emphasized the urgency of strictly implementing the Politburo’s conclusion on addressing long-standing difficulties and obstacles in projects and land management mentioned in inspection and audit conclusions and court rulings in some provinces and cities. “This is an urgent task that must be carried out with the utmost responsibility,” he stated.
The Deputy Prime Minister instructed the Government Inspectorate to incorporate the delegates’ feedback and report to the Prime Minister regarding the reorganization and supplementation of the working group members. He also directed ministries, sectors, and localities to closely follow the content, requirements, and tasks outlined in the Politburo’s directives.
Within their authority and with the support, guidance, and participation of ministries and sectors, the provinces and cities were instructed to proactively address difficulties and obstacles in projects and land management mentioned in inspection and audit conclusions and court rulings. They were also tasked with reviewing and reporting on similar projects and land cases to the competent authorities for consideration and handling.
By August 15, the ministries of Natural Resources and Environment, Planning and Investment, Construction, Finance, the State Bank of Vietnam, and Justice are required to complete the review of challenges and obstacles in their respective areas of management (land, planning, bidding, auction, citation, and application of case law) in resolving projects and land issues mentioned in inspection and audit conclusions and court rulings. Based on this review, they are to propose and report to the working group and the Prime Minister the necessary amendments to policies and laws under their specialized management, as well as those requiring the authority of the Prime Minister, the Government, or the National Assembly.
In September 2024, the ministries, sectors, and localities are to issue normative legal documents (circulars, standards, and resolutions of the People’s Councils, and decisions of the People’s Committees) to remove obstacles for projects and land mentioned in inspection and audit conclusions and court rulings. They are also to submit decrees and decisions to the Government and the Prime Minister for issuance or approval, respectively.
The Ministry of Justice was assigned to coordinate with specialized ministries to draft and submit to the National Assembly a resolution on specific mechanisms and policies to address difficulties and obstacles in projects and land management mentioned in inspection and audit conclusions and court rulings.
