The People’s Committee of Ngu Hanh Son District has inspected, supervised, and urged compliance with rectifications. The investor has since purchased and self-rectified by dismantling walls in 86/86 violating apartments on floors 2, 3, 5, and 35.

Regarding the restitution plan, the investor, Private Construction Enterprise No. 1 of Dien Bien Province, will restore the functionality of floors 2 and 3 to their original design as a motorbike parking lot. Floor 5 will be restored as a nursery and community room, and floor 35 will be reverted to a refuge room as per the design.

However, the investor proposed that competent authorities and the People’s Committee of Da Nang City allow the existence of apartments on floors 4, 41, and 42, totaling 78 apartments. The investor committed to seriously refunding the evaded profits and other expenses (if any) due to the increase in the number of apartments as regulated by the State.

The investor is in the process of reviewing the relevant documents regarding the proposed self-implemented remedial measures to submit to the competent authorities for consideration and feedback.

Mr. Phung Phu Phong, Director of the Da Nang Department of Construction, stated that this is a Grade 1 project, which was appraised by the Ministry of Construction for use. The apartment block in the project was constructed contrary to the content of the construction permit. The competent authorities are focusing on resolving these violations.

“The Da Nang Department of Construction will also base its supervision and guidance for the investor on the granted construction permit and management regulations,” said Mr. Phung Phu Phong. “Most recently, the Department of Construction coordinated with Ngu Hanh Son District to inspect and urge the investor. By the end of August, the investor must complete the remaining work and report on the progress and commitments regarding the Muong Thanh project. This is a very challenging and prolonged project. The Department of Construction is coordinating with the investor and Ngu Hanh Son District, with consultations from the Ministry of Construction, to focus on resolving these issues.”
