Revealing a Series of Businesses with Irregularities in Quang Nam

Through the inspection of mining operations at 9 enterprises, the Provincial Inspection agency of Quang Nam has identified violations at 8 units.

On February 3, Quang Nam Province Inspectorate announced that it had issued inspection conclusion on compliance with state regulations on mineral activities in Nam Tra My, Phu Ninh, Duy Xuyen, Dong Giang districts in the period from 2015 to 2022.

According to the inspection, Quang Nam Province Inspectorate has inspected 10 mining sites operated by 9 units in the above-mentioned localities. Through the inspection, the basic mineral mining units have complied well with legal documents, mining procedures, etc. However, Quang Nam Province Inspectorate also pointed out violations at 9 mining sites operated by 8 enterprises.

Firstly, with regard to Binh An Phu Investment Consultancy and Construction Joint Stock Company, which mines ordinary construction materials at Village 1 (Tra Don commune, Nam Tra My district), Quang Nam Province Inspectorate discovered total taxes and fees that the company had not paid, under-declared, or declared inaccurately, amounting to more than 182 million VND.

    

    

At Cu Lao mining site, KONGO Company installed a weighing station and camera at a location opposite the weighing station, but it is not being used.

Secondly, with regard to KONGO Investment Corporation, which mines construction materials and filling materials at Cu Lao Hill (Ngoc Giap village, Tam Dan commune, Phu Ninh district), Quang Nam Province Inspectorate discovered that the contract for leasing more than 19,000 square meters of land to build a mineral processing area had expired since 2016, but the company had not completed the extension procedure.

KONGO Company installed a weighing station and camera at a location opposite the weighing station, but it is not being used. KONGO Company signed a contract with Chi Thien Phu General Construction Company Limited for weighing stones after processing, which violates Government Decree No. 158/2016/ND-CP in 2016 (referred to as Decree 158).

Thirdly, with regard to Van Tin Thanh Trading and Transport Limited Company, which mines filling materials and rolling stones for construction materials in Tam Dan commune, Phu Ninh district, Quang Nam Province Inspectorate determined that the company did not install a weighing station and camera, violated Decree 158; did not declare and pay resource tax and environmental protection fees for the quantity of split stones that had been mined.

Fourthly, at clay mines for construction materials in Na Dac area (Thanh Xuyen village, Duy Thu commune, Duy Xuyen district), Quang Nam Province Inspectorate discovered that Phan Ngoc Anh Construction Material Trading Limited Company did not install a weighing station and camera on the transportation route from the stockpile, in violation of Decree 158.

Fifthly, with regard to Ban Son Manufacturing, Service and Trading Limited Company, which mines clay for construction materials in Dong Xe area (Phu Da 2 village, Duy Thu commune), the inspection team determined that the company did not notify in writing about the professional qualifications and capabilities of the mine manager, register the start date of mining activities, submit the mineral mining plan to the competent authority.

The company did not install a weighing station and camera on the transportation route from the stockpile as regulated. The company had earned revenue from extracting more than 4,800 cubic meters of clay, but had not paid resource tax and environmental protection fees, with an amount exceeding 135 million VND.

Sixthly, at 2 stone mines for construction materials in An Trung village (Duy Trung commune, Duy Xuyen district) operated by Quang Nam Traffic and Transport Works Construction Joint Stock Company, the inspection team determined that the company did not report the stock of granulated stone of 977 cubic meters in inventory in 2023, resulting in uncollected resource tax and environmental protection fees amounting to more than 17 million VND.

    

    

Quang Nam Province Inspectorate pointed out multiple violations in mineral mining activities of enterprises.

Seventhly, at stone mines for construction materials in A Lieng village (A Ting commune, Dong Giang district), the inspection team established that Tien Thinh Private Enterprise did not declare the amount of extracted stone (stone after blasting) of more than 1,600 cubic meters, resulting in uncollected resource tax and environmental protection fees amounting to more than 21.5 million VND.

The enterprise used an actual land area greater than the contracted area of more than 2,900 square meters without preparing a land lease application dossier.

Lastly, at sand mines for construction materials in Village 5 (Ba commune, Dong Giang district), Chien Khanh Construction – Transport Service and Trading Limited Company did not notify in writing about the professional qualifications and capabilities of the mine director sent to competent authorities.

Chien Khanh Company did not install a weighing station and camera on the transportation route for mineral products from the stockpile, implemented mining operations at a different location without approval.

The company declared and paid environmental protection fees incorrectly, with an amount less than 50 million VND; the total amount of tax and fees to be paid for more than 2,100 cubic meters of extracted gravel that had not been declared was more than 66 million VND…

Quang Nam Province Inspectorate determined that the mentioned violations belonged to 8 enterprises as mentioned above. Quang Nam Province Inspectorate requested the recovery of state budget payments for the total identified violations through inspection, which is more than 324 million VND. In addition, Binh An Phu Company must pay the taxes and fees that the above enterprises have not paid, with an amount exceeding 149 million VND…
