The Ministry of Transport has submitted to the Government a draft Decree regulating tolls on expressways. The draft Decree consists of 4 chapters and 13 articles, stipulating conditions and timing for toll collection on expressways, as well as fee collection, exemption, management, and usage regulations. It also outlines the fee structure for expressways under the management of the Ministry of Transport.

The decree aims to完善 the legal framework and clearly define the types and objects of fees, as well as implementation plans to ensure feasibility, transparency, and accountability.

Draft Decree on Toll Collection on Expressways

Tolls will only be imposed when the expressway meets the standard criteria. The draft states that toll collection can only commence after the expressway has been designed and constructed according to the technical regulations and standards for expressways and other relevant standards.

For expressway projects that received investment approval before the Law on Roads took effect, if they do not fully meet the requirements upon commencement, toll collection will begin after the completion of the construction and installation of the necessary infrastructure, including toll stations, software systems, and equipment; service facilities at rest stops; and technical infrastructure and technology for traffic management and operation.

The agency in charge of managing the expressway must develop an Asset Operation Scheme and submit it to the competent authority for approval. The timing and route of toll collection will be specified in this scheme. The management and operation of expressways will utilize the existing human resources in the transport sector, thus not requiring additional personnel to implement the decree.

Regarding toll rates, the Ministry of Transport proposes the following for state-invested expressways: Toll rates for expressways that meet all the conditions for toll implementation (Level 1) will be equivalent to 70% of the benefits gained from using the expressway (approximately 1,300 VND/vehicle-km).

For expressway projects that received investment approval before the Law on Roads took effect and do not fully meet the requirements upon commencement (Level 2), the toll rate will be equivalent to 50% of the benefits gained from using the expressway (approximately 900 VND/vehicle-km).

“With the proposed rates, it is expected that the toll collection from the 10 operational expressways will generate 3,210 billion VND/year, with 2,850 billion VND/year being contributed to the state budget,” said the Ministry of Transport.

Addressing the rationale behind the proposal, the Ministry of Transport stated that the toll rates are designed to primarily cover the costs of managing, organizing, and operating toll collection, as well as expressway maintenance. The rates also take into account the government’s socio-economic development policies and aim for transparency. Furthermore, the rates are calculated based on the benefits accrued by expressway users.

The 10 expressways expected to implement toll collection are: Hanoi – Thai Nguyen, Ho Chi Minh City – Trung Luong, Mai Son – QL45, QL45 – Nghi Son, Nghi Son – Dien Chau, Cam Lo – La Son, La Son – Hoa Lien, Vinh Hao – Phan Thiet, Phan Thiet – Dau Giay, and My Thuan – Can Tho.

The ministry also assured that there would be “no double charging” as the expressways offer greater benefits to road users compared to the parallel national highways. Users have the choice to travel on the national highways without incurring additional costs or opt for the expressways and enjoy better services and benefits. The toll collection on state-invested and managed expressways does not constitute double charging. Expressway users share the benefits with the state, and the toll rates are set lower than the benefits gained by users.

In the submission to the Government, the Ministry of Transport also provided an analysis of the expressways invested by the state before 2020, which are currently in operation or about to be. The results quantified the operating costs and time savings for vehicles, indicating that traveling on these expressways offers an average benefit of 4,824 VND/vehicle-km compared to using the parallel national highways. Of this, 25% comes from reduced operating costs, and 75% from time savings for goods and passengers.

The type of vehicle that benefits the most from using the expressways is buses with 30 seats or more, with an average benefit of over 14,000 VND/vehicle-km. The type of vehicle with the lowest benefit is light trucks below 2 tons, with an average benefit of 1,174 VND/km. The average benefit per vehicle unit is 2,616 VND/PCU/km.

The toll rates take into account the benefits analysis for vehicle owners using these expressways, as well as a sharing of benefits with expressway users. The rates are set at 50-70% of the benefits gained from using the expressway.
