The Perils of Purchasing: Đà Nẵng Issues Warning on Buying into the Three Housing Projects

On August 25th, the Danang Department of Construction announced that it had notified future homeowners that their homes under construction were eligible for sale.

There are 7 projects in total: Bac Cuong Apartment in Hai Chau District, with 112 condominium units; New Town high-rise apartment area in Ngu Hanh Son District, with 1,733 units; Lien Ke and Villa Township in the Tuyen Son Urban Area and Service Project in Hai Chau District, with 219 units; P.A Tower Hotel and Apartment Complex in Hai Chau District, with 300 condominium units; Olalani Riverside Towers project in Son Tra District, with 1,425 condominium units; East Tran Hung Dao Apartment Area in Son Tra District, with 528 units; and B4-1 and B4-2 Buildings in the Han River Tourist Service Area project in Ngu Hanh Son District, with 679 units.

The Da Nang Department of Construction notes that currently, 3 projects: New Town high-rise apartment area, Lien Ke and Villa Township in the Tuyen Son Urban Area and Service Project, and P.A Tower Hotel and Apartment Complex meet the conditions for business operations as stipulated. However, the developers of these projects have mortgaged their land-use rights or future construction projects or homes.

In cases where the investor signs a contract for the sale of a future home and receives advance payments from the buyer, the investor must submit documents proving that the mortgage has been lifted or provide a mutual agreement between the buyer and the mortgagee, stating that a lift of the mortgage is unnecessary and that the sale can proceed. These documents must be sent to the Department of Construction for review and the issuance of a notification stating that the future home meets the conditions for sale before the sales contract is signed, as per regulations.

In cases where the Department of Construction has issued a notification stating that the homes meet the conditions for sale, but the developer does not sell and instead mortgages the homes, the sale of these homes after the mortgage can only proceed if the conditions are met and a notification from the Department of Construction is provided, in accordance with the regulations.
