This proactive approach aims to shed light on the intricate balance between land values and the surrounding environment, a pivotal yet often overlooked aspect of urban development. By delving into this nuanced relationship, the city aspires to make informed decisions that foster equitable growth and a vibrant urban landscape.

On the afternoon of August 29, the Ho Chi Minh City Party Committee’s Propaganda Department and the Department of Information and Communications held a press conference to provide information on socio-economic issues in the area.

At the press conference, the Ho Chi Minh City Department of Natural Resources and Environment informed about the roadmap for adjusting the land price framework according to the 2024 Land Law. Accordingly, the roadmap for adjusting the land price framework comprises three phases:

Phase 1 (from August 1, 2024, to December 31, 2025):

Adjust the land price framework to align with the actual land prices in Ho Chi Minh City as stipulated in Clause 1, Article 257 of the 2024 Land Law.

The Department of Natural Resources and Environment stated that the adjusted land price framework would be implemented following the procedure prescribed in Article 17 of the Government’s Decree 71/2024.

The People’s Committees of districts, Thu Duc City, and Ho Chi Minh City collected and sent land price data to the Department of Natural Resources and Environment. Then, the consulting unit synthesized, analyzed, and evaluated the appropriateness of the adjusted land prices with the actual land prices in the area to build the adjusted land price framework.

The authority to adjust the land price framework in this phase belongs to the People’s Committee of Ho Chi Minh City as stipulated in Clause 1, Article 257 of the 2024 Land Law and Clause 6, Article 17 of Decree 71/2024.

Phase 2 (from January 1, 2026, to December 31, 2026):

The Department of Natural Resources and Environment is carrying out procedures to submit to the competent authority for approval of the project to build a land price framework applied for the first time from January 1, 2026, as stipulated in Clause 3, Article 159 of the 2024 Land Law.

The authority to approve the land price framework in this phase belongs to the Ho Chi Minh City People’s Council.

Phase 3 from January 1, 2027, onwards

Ho Chi Minh City will adjust, amend, and supplement the land price framework to announce and apply from January 1 of the following year (as stipulated in Clause 3, Article 159 of the 2024 Land Law).

Regarding the suggestion to “consider land prices in some areas with limited infrastructure, economic, and social conditions,” the Department of Natural Resources and Environment said that it had received and transferred this suggestion to the consulting unit for research, evaluation, and determination of appropriate land prices.

The results of the comments’ reception and the adjustment of land prices in the land price framework will be considered and appraised by the Ho Chi Minh City Land Price Appraisal Council following the procedure.

The Department of Natural Resources and Environment also provided information on the need to assess the impact on some affected groups, focusing on households and individuals’ land-use purpose conversion.

According to the department, this issue received the most comments, and the consulting agency also pondered during the drafting process.

However, in principle, the land price framework must reflect the actual land prices prevalent in the market under normal conditions, following the Party’s guidelines in Resolution 18 and the provisions of the 2024 Land Law.

The collection rates and ratios for this obligation will be specified in documents issued by central agencies.

The Department of Natural Resources and Environment has advised the People’s Committee of Ho Chi Minh City to report and propose to the Prime Minister to consider and approve assigning relevant ministries and sectors to advise and promulgate policies on collection rates and ratios suitable for the adjusted land price framework.
