Gold Shops Caught Violating Regulations, Fined Nearly 3 Billion VND

According to the General Department of Market Management (GOMM), in the first 4 months of 2024, the MMF nationwide detected 145 violations at gold shops, with a total value of nearly 6.8 billion VND, and administrative fines of nearly 3 billion VND.

Typically, the Tien Giang provincial MMF inspected and detected 5 violations, and processed 1 case (4 cases are completing the processing records), with a total value of over 1.8 billion VND. In which, Kim Huong Dinh gold shop in Long Xuyen city has many gold and white gold products being sold with signs of violations.

According to the GOMM, one of the most detected violations in the recent past is that gold shops sell jewelry with signs of counterfeiting many famous brands.

The common counterfeit trademark violations for jewelry items detected in the recent past are engraving trademarks under protection on jewelry, and crafting jewelry components containing protected trademarks.

Accordingly, engraving trademarks of Louis Vuitton, Hermès, Chanel, Dior… on products or crafting pendants, rings, and earrings with designs that match the protected trademarks.

The GOMM also clarified that violations of intellectual property rights (infringement of trademark rights, trademark counterfeiting) can be subject to administrative fines of up to VND 250 million for individuals and VND 500 million for organizations.

In case organizations or individuals violate on a commercial scale or illegally profit from VND 100 million or more, or cause damage to trademark owners from VND 200 million or more, or the value of infringing goods is from VND 200 million or more, they can be prosecuted, according to Article 226 of the Penal Code 2015, amended and supplemented in 2017.
