Unveiling Corruption: Quang Nam Province’s Inspectorate Uncovers Widespread Irregularities at Chu Lai Infrastructure Company

On July 18, the Inspectorate of Quang Nam province announced that it had issued inspection conclusions on the production and business activities over the past three years (2021, 2022, and 2023) and several basic construction investment projects at the Chu Lai Industrial Zone Infrastructure Development One-Member Limited Liability Company (referred to as Chu Lai Infrastructure Company).

The Chu Lai Industrial Zone Infrastructure Development One-Member Limited Liability Company is in charge of managing, investing in, and operating the infrastructure of several industrial parks in Quang Nam province.

According to the inspection conclusions, alongside certain achievements, there were still some shortcomings and violations in economic management, financial management, and basic construction investment management during the three-year operation of the Chu Lai Infrastructure Company from 2021 to 2023.

Regarding the production and business performance over the three years (2021-2023) at the Chu Lai Infrastructure Company, the Quang Nam Provincial Inspectorate determined that there were certain expenses deducted when calculating corporate income tax that did not comply with regulations, totaling over VND 456 million.

For expenses of a welfare nature, which should not exceed one month’s average salary when calculating corporate income tax, the inspection found that the Chu Lai Infrastructure Company had expenses for holidays, festivals, and production and business activities (6 months, 9 months, etc.) that were inconsistent with the regulations.

The company recorded in its expenses direct welfare payments to employees exceeding the regulation of not surpassing one month’s average salary actually implemented in the tax calculation year, totaling over VND 2.25 billion.

Despite continuous losses in its business performance, the company still awarded a “Labor Excellence” bonus of VND 60 million in 2022 (with a business loss of over VND 6.3 billion in that year).

Regarding the management and implementation of basic construction investment projects, the inspection identified 16 works with settlement volumes exceeding the actual construction; and incorrect application of settlement norms, totaling over VND 550 million.

During the construction of projects in the Chu Lai North Industrial Park, the Chu Lai Infrastructure Company obtained soil from Ong Huyen Hill for land leveling and road construction. The company has not yet paid the environmental protection fee of VND 179.3 million…

Given the identified violations and shortcomings, the Quang Nam Provincial Inspectorate requested the Chu Lai Infrastructure Company to inspect the responsibilities of the members’ council, the management board, and individuals involved in the shortcomings and violations in financial management and basic construction investment during the three years (2021, 2022, and 2023).

It is necessary to recover and return to the state budget a total of over VND 825 million in violated funds. This includes corporate income tax collection related to certain expenses that were deducted inappropriately, totaling VND 45.3 million; financial management and usage at the Service Business and Construction Installation Enterprise – a branch of the Chu Lai Infrastructure Company, totaling VND 26.7 million; basic construction investment project management and implementation, totaling VND 53.1 million; and violations in construction, acceptance, and settlement of works, totaling VND 550 million…

The company must also pay the environmental protection fee for the soil obtained from Ong Huyen Hill for land leveling and road construction, amounting to VND 179.3 million…

For the amounts exceeding the one-month salary limit paid to employees, totaling over VND 2.25 billion, the Chu Lai Infrastructure Company is responsible for adjusting the reduction in expenses, increasing profits, and accounting for the disbursement from the Welfare Fund. At the same time, they must comply with regulations on paying the state budget.
