The People’s Committee of Ho Chi Minh City has issued a decision on determining the areas where real estate investors and housing construction investors are allowed to transfer the land-use rights with technical infrastructure to organizations and individuals for self-construction of residences.

This decision is made in accordance with Clause 6, Article 31 of the 2023 Law on Real Estate Business and will take effect in Ho Chi Minh City from October 21, 2024.

According to the decision, real estate investors and housing construction investors in Ho Chi Minh City are not permitted to transfer land-use rights with technical infrastructure to organizations and individuals for self-construction of residences within their projects.

However, an exception is made for real estate and housing construction projects with the objective of resettlement using land plots in the communes, towns, and districts of Ho Chi Minh City.

In these cases, investors are allowed to transfer land-use rights with technical infrastructure to individuals for self-construction of residences within the resettlement projects.

When implementing resettlement projects, investors must provide written notification to the Department of Construction and the People’s Committee of the district where the project is located. The local authorities are responsible for inspecting, supervising, and establishing records to monitor the construction of technical infrastructure in these projects.
