On August 6, the Da Nang Construction Department provided information to the press regarding the handling of illegal construction at the Muong Thanh Hotel and Son Tra Luxury Apartment complex.
According to the Construction Department, the Da Nang People’s Committee issued a decision to enforce (Decision 4527/QD-CCXP dated October 7, 2019, and Decision 5449/QD-SDCCXP dated November 29, 2019, amending and supplementing the former) the demolition of violations at the Muong Thanh Hotel and Son Tra Luxury Apartment complex. They also issued Decision 5516/QD-UBND on December 4, 2019, approving the demolition plan.
In these decisions, the Da Nang People’s Committee assigned the People’s Committee of Ngu Hanh Son District to take charge and organize the implementation, including conducting bidding and selecting a demolition contractor, as well as preparing for and carrying out the demolition work.
However, the implementation process encountered some issues and obstacles. Based on the reports and proposals of the People’s Committee of Ngu Hanh Son District, suggesting self-demolition and remediation by the investor, the Da Nang People’s Committee issued documents extending the enforcement decision and requesting relevant departments to inspect and handle the case in accordance with regulations.
According to a report by the People’s Committee of Ngu Hanh Son District (dated June 14, 2024), the investor has purchased and voluntarily complied with the self-remediation by demolishing the walls of a total of 86/86 violating apartments on floors 2, 3, 5, and 35 (26 apartments on each of floors 2, 3, and 5, and 8 apartments on floor 35).
Regarding the remediation plan, floors 2 and 3 will be returned to their original function as a motorcycle parking lot. Floor 5 will be restored to a nursery and community room, and floor 35 will be reverted to a refuge room, in line with the original design.
However, the investor proposed that the competent authorities and the Da Nang People’s Committee allow the retention of the apartments on floors 4, 41, and 42, totaling 78 apartments. The investor committed to seriously implementing the refund of the illegally obtained profits and other expenses (if any) due to the increase in the number of apartments as stipulated by the law.
“In carrying out the task assigned by the City People’s Committee, after considering the proposals of Private Enterprise No. 1 Dien Bien in Official Dispatch No. 43/DN1-MTSH dated June 6, 2024, on self-remediation and return to functionality along with the attached plan, the Construction Department found that the proposed plan by the investor does not comply with regulations. Therefore, the Construction Department requested the investor to review and report on the above contents to the Department. The Construction Department will then synthesize and report to the City People’s Committee for consideration and decision,” the Construction Department stated.
The Muong Thanh Hotel and Son Tra Luxury Apartments (located at Lot A1, Vo Nguyen Giap Street, My An Ward, Ngu Hanh Son District, Da Nang City) are invested by Private Enterprise No. 1 Dien Bien.
This project was granted a construction permit No. 235/GP-SXD dated February 17, 2016, with a scale of 42 floors and 2 basements. However, during the construction process, the investor illegally changed the function of several floors and converted the entire parking lot and nursery area into hundreds of apartments for sale, violating the permitted design.
