The Ministry of Natural Resources and Environment has issued Circular No. 10/2024/TT-BTNMT on regulations regarding land dossiers, land use rights certificates, and ownership of assets attached to land (Red Book/Pink Book).

According to the Circular, the specimen of the Certificate of Land Use Rights and Ownership of Houses and Other Assets Attached to Land, as stipulated in the Ministry of Natural Resources and Environment’s Circular No. 23/2014/TT-BTNMT dated May 19, 2014, on the issuance of the Certificate of Land Use Rights and Ownership of Houses and Other Assets Attached to Land, will continue to be used until December 31, 2024.

QR CODE EQUALLY VALID AS INFORMATION ON THE CERTIFICATE

The new certificate will consist of a single sheet with two pages, printed with a bronze drum pattern background in lotus pink, measuring 210mm x 297mm.

Page 1 of the Certificate of Land Use Rights and Ownership of Assets Attached to Land includes the National Emblem, Country Name; the phrase “Certificate of Land Use Rights and Ownership of Assets Attached to Land” in red; QR code; and Certificate Code.

Page 1 displays three sections: Land User and Owner of Assets Attached to Land; Land Plot Information; and Information on Assets Attached to Land; location, date, and signing authority of the Certificate; certificate issue number (serial number); and the phrase “Detailed information is presented in the QR code.”

Page 2 includes sections: Plot Map and Assets Attached to Land:”; Notes; Changes after Certificate Issuance; Certificate Registration Number; and Notes for the Certificate Holder.

Regarding the QR code on the Certificate, the Circular states: the QR code printed on the Certificate is used to store and display detailed information of the Certificate, as well as management information of the QR code.

Feedback from the QR code holds the same value as the information on the Certificate, consistent with the information in the land database or the dossier if the database is not yet established.

The implementation of providing a QR code on the Certificate must comply with technical requirements for the QR code 2005 standard according to Vietnamese standard TCVN 7322:2009.

The QR code on the Certificate must be generated and printed using the same local land database management software application and integrated into the national land database.

The size of the QR code printed on the Certificate is 2.0 cm x 2.0 cm. The QR code is positioned in the upper right corner of page 1 of the Certificate of Land Use Rights and Ownership of Assets Attached to Land for the initial printing. In case of changes after the issuance of the Certificate, the QR code is displayed in the right corner of the “Changes and Legal Basis” column on page 2 of the Certificate.

The Certificate Code is unique nationwide and is automatically generated by the land information system software when the National Land Information System is officially operated and exploited.

The Certificate Code is positioned in the upper right corner, just below the QR code on page 1 of the Certificate of Land Use Rights and Ownership of Assets Attached to Land. It consists of a set of 12 letters and numbers as specified.

INFORMATION ON LAND USER AND OWNER OF ASSETS ATTACHED TO LAND

According to the new Circular, for individuals not covered by the provisions of Clause 2 of this Article, the following information shall be indicated: “Mr.” or “Mrs.”, surname and given name(s), type and number of personal identification document. For foreigners or overseas Vietnamese, the following information shall be indicated: “Mr.” or “Mrs.”, surname and given name(s), nationality, type and number of personal identification document.

In the case of a husband and wife jointly owning assets that are land use rights and assets attached to the land, the following information shall be indicated: “Mrs.” or “Mr.”, surname and given name(s), type and number of the personal identification document of the wife or husband, followed by: “and husband (or wife): … (indicate the information of the husband or wife).”

If the husband and wife agree to have the wife’s or husband’s name recorded as the representative on the Certificate, the following shall be indicated: “Mrs.” or “Mr.”, surname and given name(s), type and number of personal identification document, followed by: “as the representative of the husband and wife.”

For organizations, the name of the organization shall be indicated as stipulated in Point c Clause 2 of this Circular, and the information of the organization’s legal document shall be indicated as stipulated in Points c, d, dd, e, and g Clause 3 of this Circular.

In the case of a group of land users and owners of assets attached to land, where the Certificate is issued to each member of the group, the information of the person to whom the Certificate is issued shall be indicated in accordance with the provisions of Clauses 1, 3 and 4 of this Article. The following shall be added: “Co-using land, co-owning assets attached to land (or Co-using land or Co-owning assets attached to land) with other persons”. The QR code of the Certificate shall contain the complete information of those who jointly own the land use rights and assets attached to the land.

In the case of a group of land users and owners of assets attached to land, where a single Certificate is issued to the representative of the group, the information of the representative shall be indicated in accordance with the provisions of Clauses 1, 3 and 4 of this Article. The following shall be added: “as the representative of the group of land users” or “as the representative of the group of owners of assets attached to land” or “as the representative of the group of land users and owners of assets attached to land”. The QR code of the Certificate shall contain the complete information of those who jointly own the land use rights and assets attached to the land.

In the case of issuing a Certificate to members of a household with common land use rights, the complete information of the members shall be indicated in accordance with Clause 1 of this Article.

If the information of all members with common land use rights cannot be fully indicated on the Certificate, the information of one or some members with common land use rights shall be indicated. The following shall be added: “and other members with common land use rights of the household, as indicated in the QR code”. The QR code of the Certificate shall contain the complete information of those who jointly own the land use rights.

If the members of the household agree to have the representative’s name recorded on the Certificate, the information of the representative shall be indicated in accordance with Clause 1 of this Article, followed by: “as the representative of the household members with common land use rights”. The QR code of the Certificate shall contain the complete information of those who jointly own the land use rights.
