Decree 29/2024/ND-CP specifies the criteria for each public servant leadership and management position in the ministries, in the General Departments and of the professional agencies of the People’s Committees at the provincial and district levels.

Decree No. 29/2024/ND-CP of March 6, 2024, issued by the Government, provides regulations on the criteria for public servant leadership and management positions in state administrative agencies, effective from May 1, 2024.

The Decree provides the general criteria applicable to all public servant leadership and management positions, including: criteria on political ideology; criteria on morality, lifestyle, organizational discipline; criteria on qualifications; criteria on competence and reputation; criteria on health, age, and work experience.

Decree 29/2024/ND-CP specifies the criteria for each public servant leadership and management position in the ministries, in the General Departments and of the professional agencies of the People’s Committees at the provincial and district levels.

Conditions for the establishment of industrial clusters

The Government issued Decree No. 32/2024/ND-CP on March 15, 2024, on the management and development of industrial clusters, effective May 1, 2024. The Decree clearly sets out the conditions for the establishment and expansion of industrial clusters.

The Decree stipulates that the establishment of industrial clusters must meet the following conditions:

Be included in the List of industrial clusters in the province, approved by the competent authority; have land fund in accordance with the land use planning in the district;

Have enterprises, cooperatives, organizations with legal capacity and investment capacity to invest in the construction of technical infrastructure, and propose to be the investor in the construction of technical infrastructure of the industrial cluster;

In case the district has established industrial clusters, the average occupancy rate of industrial clusters must reach over 50%, or the total industrial land fund not yet leased of industrial clusters does not exceed 100 ha.

9 types of dangerous goods

Effective May 15, 2024, Decree No. 34/2024/ND-CP of March 31, 2024, issued by the Government, provides a list of dangerous goods and the transportation of dangerous goods by road motor vehicles and inland waterway vehicles.

Decree 34/2024/ND-CP states: Dangerous goods are goods containing hazardous substances that, when transported by road or inland waterway, can harm the life, health, and well-being of human beings, the environment, and the security and stability of the nation.

Depending on their chemical and physical properties, dangerous goods are divided into 9 types and groups.

New regulations on conferring the titles “People’s Teacher” and “Meritorious Teacher”

Decree 35/2024/ND-CP issued by the Government on April 2, 2024, provides regulations on the conferring of the titles “People’s Teacher” and “Meritorious Teacher”, effective from May 25, 2024.

Specifically, the subjects of application are teachers, educational managers, and educational researchers, including:

+ Teachers and managers at educational institutions who are responsible for caring for, nurturing, educating, and teaching in educational institutions in accordance with the provisions of the Law on Education;

+ Managers who are responsible for managing at educational management agencies in accordance with the provisions of the law (collectively referred to as managers at educational management agencies);

+ Educational research staff who are responsible for research on the science of education and training, and vocational education;

+ Teachers, managers at educational institutions, managers at educational management agencies, and educational researchers who have retired under the social insurance regime between two consecutive award years;

+ Teachers, managers at educational institutions, managers at educational management agencies, and educational researchers who have retired under the social insurance regime continue to be regular teachers, lecturers, and managers at private and non-public educational institutions.

Conferring the “Ho Chi Minh Prize” and “State Prize” for Literature and Arts

Decree 36/2024/ND-CP dated April 4, 2024, provides detailed regulations on the conferring of the “Ho Chi Minh Prize” and “State Prize” for literature and arts, effective from May 20, 2024.

The Decree states that the conferring of the “Ho Chi Minh Prize” and the “State Prize” for literature and arts must ensure the following principles: A work, group of works, project, or group of projects (work, project) in literature and arts of an author may only be nominated for one specialized field in literature and arts.

Works and projects in literature and arts of an author that have been awarded the “State Prize” for literature and arts shall not be combined with other works and projects in literature and arts to be nominated for the “Ho Chi Minh Prize” for literature and arts.

Councils at all levels may only submit to the competent superior level for consideration cases that meet the requirements, criteria, procedures, and documents prescribed.

Violations of regulations on fishing in prohibited areas subject to fines of up to 90 million VND

Decree 38/2024/ND-CP dated April 5, 2024, issued by the Government, provides regulations on administrative violations, forms, levels of sanctions, remedial measures, authority to draw up records, and authority to impose sanctions for administrative violations in the field of fisheries.

Regarding the regulations on fishing in prohibited areas, the Decree imposes fines of 70 – 90 million VND for the use of fishing vessels with a length of 24 m or more for trawling, fishing, and fishing gear combined with light (except for squid fishing) in prohibited fishing areas or prohibited fishing areas for a period of time, without reaching the level of criminal prosecution.

Violations of the regulations on the management of endangered, rare, and precious aquatic species shall be penalized with a fine of 10 – 200 million VND.

Violations of the regulations on the management of marine protected areas shall be penalized with a fine of 50 – 200 million VND.

Regarding violations of the regulations on aquatic species, the Decree imposes a fine of 40 – 50 million VND for producing, raising, or culturing aquatic species that are not included in the List of aquatic species permitted for business in Vietnam or have not been recognized or have not been permitted by the competent authority, without reaching the level of criminal prosecution.

Violations of the regulations on aquatic feed and environmental treatment products for aquaculture shall be fined from 2 – 50 million VND.

The Decree is effective from May 20, 2024.

Mechanism for adjusting the average retail electricity price from May 15

Deputy Prime Minister Le Minh Khai signed Decision No. 5/2024/QD-TTg on March 26, 2024, providing regulations on the mechanism for adjusting the average retail electricity price.

Accordingly, regarding the principle of adjusting the average retail electricity price, annually, after reviewing the production and business costs of electricity in year N-2 of Vietnam Electricity Group, the average retail electricity price in year N is reviewed and adjusted according to objective changes in input parameters at all stages (power generation, electricity transmission, distribution – retail electricity, power system operation, and administration of electricity market operations, auxiliary services of the power system and administration – management of the industry) and the allocation of other costs not included in the electricity price.

During the year, the average retail electricity price is reviewed and adjusted on the basis of the updated costs of the power generation stage and the costs of purchasing electricity from power plants providing auxiliary services according to the basic input parameters in the power generation stage and other costs not included in the electricity price.

When the average retail electricity price decreases by 1% or more compared to the current average retail electricity price, the electricity price is allowed to be adjusted downwards accordingly.
