A Bank Official and His Brother Allegedly Conspired to Steal Two Houses Worth $2.4 Million

On July 10, the Criminal Police Department of Danang City Public Security initiated legal proceedings and detained two suspects, 41-year-old Pham Nguyen Minh Trung, a resident of Ward 6, Soc Trang City, Soc Trang Province, and 46-year-old Pham Nguyen Minh Tan, a resident of Thanh Phuoc Ward, Binh Minh Town, Vinh Long Province, for alleged involvement in fraudulent activities leading to charges of "appropriation of property through deceitful means."

Initial investigation results determined that, in late 2019, a couple, Mr. Tran Thien S. (51 years old) and Mrs. Phan Minh N.H. (49 years old), residing in Nam Duong ward, Hai Chau district, Da Nang city, intended to sell two houses located on Tio La street and Ton Duc Thang street in Da Nang city. They posted this information on social media.

In May 2020, through a broker, Mr. S. connected with Pham Nguyen Minh Trung, who was interested in purchasing the properties. After several phone conversations, they agreed on a selling price of 56 billion VND for both houses. Pham Nguyen Minh Trung agreed to the purchase and informed Mr. S. that a bank with a branch in Soc Trang province would guarantee the payment. Trung then invited Mr. and Mrs. S. to Soc Trang to finalize the home-buying process.

Subsequently, Mr. and Mrs. S., along with Trung, drafted a Three-Party Land Use Rights Transfer Agreement. This agreement included Trung as the buyer, Mr. and Mrs. S. as the sellers, and a bank branch represented by Trung’s brother, Pham Nguyen Minh Tan, as the payment guarantor.

Following the agreement, the couple and Trung went to a notary office on Ngo Quyen street in Da Nang city to establish a Contract for Transfer of Land Use Rights and Assets Attached to Land for the two houses. During this process, Trung paid Mr. and Mrs. S. 1 billion VND as a deposit.

On June 23, 2020, Mr. and Mrs. S. completed the procedure to transfer ownership of the two houses to Pham Nguyen Minh Trung. However, after acquiring ownership, Trung and Tan did not mortgage the properties to the bank to obtain funds for the payment to Mr. and Mrs. S. Instead, they sold the two houses to another party for tens of billions of VND and used the money for their personal expenses.

After a period of not receiving the money owed to them, Mr. and Mrs. S. filed a complaint about the actions of Trung and Tan to the police.

The case is currently under further investigation by the Criminal Police Department of the Da Nang City Police.
