Unlimited Land Fund for Infrastructure Investment Projects in Industrial and Energy Zone

Deputy Prime Minister Tran Hong Ha emphasized that the adjustment of land use targets is not limited to infrastructure investment projects, industrial parks, and energy.

On March 5, Deputy Prime Minister Tran Hong Ha directly and online worked with ministries, sectors, and localities on the draft decision on adjusting the land use allocation targets by 2025, as allocated by the Prime Minister under Decision No. 326/QD-TTg.

According to the report of the Ministry of Natural Resources and Environment, the implementation of the national land use plan targets has been allocated to many localities at a very low rate, but there is still a proposal for additional adjustments.

In addition to some localities with urgent needs, the general proposal for adjustment of some types of land such as industrial land, transportation land… is still speculative, not based on the results of implementation, the occupancy rate of industrial zones, land conversion linked to economic restructuring, the capacity of technical infrastructure, social infrastructure, resources, and investment attraction ability…

Some provinces have included land use needs in provincial planning, district-level land use plans, but have not met all the conditions to implement at the current time.

Some provinces have not done well in reviewing and appraising land use needs in the process of formulating land use planning and plans, resulting in proposals for land use needs of localities much larger than reality being the cause for not putting land into use, slow land use, affecting the rights of land users, causing wasteful land and social resources invested in land.

The Ministry of Natural Resources and Environment has reviewed and completed 7 principles for adjusting land use targets among provinces allocated to by 2025 under Decision No. 326/QD-TTg.

Deputy Minister of Natural Resources and Environment Le Minh Ngan said that adjusting land use targets ensures fairness, transparency, efficiency, and saves on the basis of balancing the land use needs of industries, sectors, localities, in line with practical conditions and ensuring the general development goals of the country.

Accordingly, the Ministry of Natural Resources and Environment proposed to adjust down non-agricultural land use targets according to the localities’ proposals; localities have land area statistics that do not match the intended use, targets for industrial land that have not been implemented and implemented under 5%, targets for transportation land that have not been implemented and implemented under 5%.

At the same time, priority is given to adding land use targets for provinces with high implementation results and proposals attached to legal basis for organization and implementation of projects

Priority will be given to adding industrial land use targets for provinces with high implementation results, belonging to dynamic regions, strong economic growth… having advantages in infrastructure structure, investment attraction ability.

Various types of land for infrastructure development are concentratedly arranged for important national projects, focal projects on transportation, energy in the 2021-2025 period; projects outside the list of mid-term public investment plans of the 2021-2025 period, suitable to planning, having significant importance to socio-economic development.

At the meeting, localities achieved a high level of consensus, understanding, and sharing of requirements and plans for adjusting land use targets; exchanging, proposing the Ministry of Natural Resources and Environment to unify data on actual land use targets in some localities; studying solutions for localities that have used up the targets of some types of land allocated…

Conclusion of the meeting, Deputy Prime Minister Tran Hong Ha emphasized that adjusting land use targets aims to create favorable conditions for localities with favorable opportunities to develop first, “not pursue perfection, only adjust urgent issues, projects, and projects waiting for land”, and not change the total land use targets of localities until 2030.

“The land use targets will not be limited for infrastructure investment projects in industrial zones, energy… according to planning to timely catch investment opportunities, as well as projects according to general planning, detailed planning approved by the Prime Minister, authorized agencies”, Deputy Prime Minister emphasized.

In addition, Deputy Prime Minister also noted that localities need to closely coordinate with the Ministry of Natural Resources and Environment in reviewing land use needs of projects, their feasibility, investor commitments, staging… until before the effective date of the Land Law (amended) in 2024, effective from January 1, 2025, to propose and resolve comprehensively land use needs to submit to the National Assembly for consideration and issuance of a resolution adjusting the national land use plan for the 2021-2025 period.

The Ministry of Natural Resources and Environment, in coordination with the Ministry of Planning and Investment and relevant ministries and sectors, will draft and submit documents to competent authorities to delegate localities to implement planning implementation, land use planning on the ground.
