Issuance of 16 detailed documents regulating Land Law

Deputy Prime Minister Tran Hong Ha has signed Decision No. 222 /QD-TTg on March 5, 2024 by the Prime Minister to issue the Plan for implementing the Land Law No. 31/2024/QH15. The plan was issued to organize the implementation of the Land Law, to ensure timely, synchronized, unified, effective and efficient enforcement.

According to this decision, the Prime Minister assigns the agencies to draft 16 detailed documents regulating Land Law falling under the jurisdiction of the Government, the Prime Minister, the Minister.

The Ministry of Natural Resources and Environment is assigned to take the lead, coordinate with relevant ministries and departments to develop and submit to the Government for issuance 6 Decrees; to issue 4 Circulars according to their jurisdiction to regulate the details of the Land Law.

The Prime Minister assigns the Ministry of Finance to take the lead, coordinate with relevant ministries and departments to develop and submit to the Government for issuance 2 Decrees, to issue 01 Circular according to their jurisdiction to regulate details of the Land Law …

The Prime Minister requests ministries, sectors and localities to urgently build according to the prescribed sequence and procedures in the Law on Promulgation of Legal Normative Documents, submitted to the Government for issuance, issued according to their jurisdiction in May 2024.

Regarding the draft Decree regulating reclamation at sea according to the assigned task at Article 190 of the Land Law 2024: The Ministry of Natural Resources and Environment will develop, complete, submit for promulgation the Decree under the shortened procedure to ensure its effectiveness from April 1, 2024.

Submit two pilot projects to the National Assembly

The Prime Minister requires the Ministry of Natural Resources and Environment to take responsibility for building and implementing a program to disseminate and educate the law on land to raise awareness of land policies and laws for domestic organizations, subordinate religious organizations, individuals in the country, Vietnamese people permanently residing abroad who are Vietnamese citizens and the population.

The Ministry of Natural Resources and Environment takes the lead and coordinates with the Ministry of Information and Communications, ministries, sectors, and localities to build a propaganda plan including training for People’s Committees and land management officials at all levels; communicate policies to people, businesses on new provisions of the Law and detailed legal documents guiding the implementation of the Law …

The Ministry of Natural Resources and Environment is also assigned the task of leading and coordinating with relevant ministries and agencies to build a project for the Government to submit to the National Assembly on piloting the commercial housing project through agreements on land use rights or currently having land use rights for other land, and submit it before March 10, 2024.

The Prime Minister assigns the Ministry of Planning and Investment to take the lead, coordinate with the Ministry of Natural Resources and Environment and relevant ministries and agencies to develop a pilot resolution on the separation of land clearance, resettlement from investment projects, and submit it before March 10, 2024.

The Ministry of Justice is assigned to take the lead, coordinate with the Ministry of Natural Resources and Environment and the Ministry of Planning and Investment to report to the Standing Committee of the National Assembly for permission to incorporate the two above-mentioned pilot projects into the Working Program of the National Assembly at the 7th meeting in May 2024.

On the afternoon of March 5, presiding over a working session with ministries, branches, and localities on the draft decision to adjust the allocation of land use targets until 2025, Deputy Prime Minister Tran Hong Ha emphasized that adjusting the land use targets aims to create conditions for localities with favorable opportunities to develop first, not to be demanding, only to adjust urgent issues, construction works, projects waiting for land, and not to change the total land use target of localities until 2030. According to the Deputy Prime Minister, the land use targets are not limited to infrastructure investment projects, industrial zones, energy … according to the planning to timely seize investment opportunities, as well as projects according to general planning, detailed planning approved by the Prime Minister, competent level.
