Heavy penalties imposed on Thanh Hoa’s mining giants

Over the last month alone, numerous mining businesses in Thanh Hoa province have been fined hundreds of millions of Vietnamese dong due to violations during their operations. These penalties have been imposed as a result of various infractions committed by these companies, ranging from environmental violations to improper licensing. The local authorities have taken a strong stance against these violations and are actively enforcing regulations to protect the environment and ensure the proper functioning of the mining industry. These actions demonstrate the province's commitment to holding businesses accountable for their actions and maintaining a sustainable and responsible mining sector.

Specifically, on March 5th, the People’s Committee of Thanh Hoa province issued Decision No. 898/QD-XPHC imposing a fine on Thanh Hoa Mining Technology Joint Stock Company, located in Ba Dinh Ward, Bim Son town, for an amount of 500 million VND. This company exceeded the permitted mining capacity as stated in Mining Permit No. 126/GP-UBND dated April 3, 2017, by more than 100% annually. Specifically, in 2022, Thanh Hoa Mining Technology JSC exceeded the capacity by 321%, in 2023 exceeded by 80.6%; averaging over 200.8% in the past 2 years.

Due to the severity of the violations, the People’s Committee of Thanh Hoa province requires Thanh Hoa Mining Technology JSC to implement measures to rehabilitate environmental protection works due to excessive mining activities.

Prior to that, the People’s Committee of Thanh Hoa province issued Decision No. 658/QD-XPHC on administrative penalties against Minh Tuan Investment Construction Joint Stock Company, located at 45 Cao Son Street, An Hung Ward, Thanh Hoa city, with a fine of 350 million VND. This company conducted mining activities on an area exceeding the permitted mining area (according to surface area) by more than 14,108 m2 for mining area between 1 ha and less than 1.5 ha. Minh Tuan Investment Construction Joint Stock Company had its mining license revoked for a period of 11.25 months, starting from the effective date of this Decision, and was required to rehabilitate and restore the environment, as well as take measures to bring the areas that exceeded the permitted mining area back to a safe state.

Decision No. 898/QD-XPHC against Thanh Hoa Mining Technology Joint Stock Company

Furthermore, the People’s Committee of Thanh Hoa province issued Decision No. 715/QD-XPHC imposing an administrative fine of 170 million VND on Tung Lam LLC, located in Luong Dien hamlet, Tung Lam commune, Nghi Son town, for mining activities on an area exceeding the permitted mining area (according to surface area) by more than 9,582.6 m2 for mining area between 0.5 ha and less than 1 ha. In addition, the People’s Committee of Thanh Hoa province requires Tung Lam LLC to implement measures to bring the areas that exceeded the permitted mining area back to a safe state.

The People’s Committee of Thanh Hoa province issued Decision No. 761/QD-XPHC imposing a fine of 150 million VND on Hung Hao Investment and Development Joint Stock Company, located in An Hung Ward, Thanh Hoa city. This company committed an administrative violation by failing to submit a request to close the mine to the competent state agency within 6 months from the expiration date of the mining license in accordance with the regulations.

Decision on administrative penalties of more than 1.8 billion VND against the Director of Inspection, Ministry of Natural Resources and Environment regarding Cong Thanh Cement Joint Stock Company

Additionally, the People’s Committee of Thanh Hoa province issued Decision No. 803/QD-XPHC imposing a fine of 70 million VND on Tan Hong Phuc LLC, located in Tan Cong Street, Dong Tan Ward, Thanh Hoa city. This company failed to comply with one of the approved conclusions of the environmental impact assessment report, such as not constructing a system for collecting and discharging rainwater and not constructing a waste storage site for soil and rock waste generated from the mining and processing process.

Recently, the Director of Inspection, Ministry of Natural Resources and Environment issued Decision No. 28/QD-XPHC imposing administrative penalties of more than 1.8 billion VND against Cong Thanh Cement Joint Stock Company, located in Tam Son hamlet, Tan Truong commune, Nghi Son town, in relation to a series of violations in the field of environmental mining. Specifically, this company delayed and evaded the implementation of administrative penalties in the field of environmental protection by the competent authority, failed to fully comply with the contents and requirements in the inspection and examination conclusions on environmental protection of the competent state agency, does not have an environmental permit as required for the basalt mine mining project at Hon Boi mountain, does not have an environmental permit as required for Investment Project 1 production line and Investment Project 2 construction line of Cong Thanh Cement Plant.

This company does not have an environmental permit as required for the limestone mine project as raw material for Cong Thanh Cement Plant, and does not have an environmental permit as required for the clay mine project as raw material for Cong Thanh Cement Plant.
