To promptly implement the laws and resolutions passed by the National Assembly at the 6th session and the 5th extraordinary session, on the morning of March 7, 2024, the Standing Committee of the National Assembly organized the second national conference to implement the laws and resolutions of the 6th session and the 5th extraordinary session of the 15th National Assembly. Chairman of the National Assembly, Vuong Dinh Hue, chaired the conference.

NEW POINTS OF 19 LAWS AND RESOLUTIONS

According to Deputy Permanent Chairman of the National Assembly, Tran Thanh Man, this conference aims to ensure the implementation of the laws and resolutions by the Government, local ministries and agencies, and relevant organizations in accordance with the regulations of the National Assembly, the People’s Council, and the people, businesses, and contributions by the National Assembly, deputies, and voters in overseeing and evaluating the implementation of the laws and resolutions.

Summing up the new points, key contents, requirements, and main tasks in implementing the 19 laws and resolutions passed by the National Assembly, Deputy Chairman of the National Assembly, Nguyen Khac Dinh emphasized that the laws passed by the National Assembly promptly institutionalized the Party’s orientations on building and perfecting institutions, timely removing difficulties and barriers, creating the most favorable conditions for the legitimate rights and interests of the people and businesses, and enhancing administrative reform.

In particular, administrative procedures guarantee transparency, non-discrimination, and equal treatment between Vietnamese individuals in and outside the country, and between enterprises of different economic sectors, contributing to promoting socio-economic development and state management effectiveness. These are clearly demonstrated in many provisions of the Land Law, Housing Law, and Citizen Identity Card Law.

The laws have supplemented and improved the regulations on state management, clarifying the functions, tasks, and powers of state management agencies in various fields, ensuring the centralized and unified management by the central authorities, implementing strong decentralization and delegation of power, while emphasizing the responsibility of the leading agencies and establishing appropriate mechanisms between the relevant specialized agencies for specific control and supervision, ensuring the enhancement of the effectiveness and efficiency of state management.

The laws have timely addressed practical issues, ensuring the principle of market orientation towards socialist society, supplementing regulations for the internal legalization of international conventions, ensuring compliance with international standards and practices in related activities, and meeting the proactive and positive requirements of international integration in accordance with the Party’s direction.

Especially, the laws and resolutions have been highly appreciated by the public, with many opinions from experts and businesses commending the draft completion process, the timing of examination, and the voting. The contents of the laws have initially received high social consensus, especially for the key contents and new regulations. It is expected that these provisions will be synchronously implemented by the agencies, timely, and effectively.

EARLY IMPLEMENTATION OF POLICIES AND REGULATIONS

The Standing Committee of the National Assembly proposes that the Government and its agencies promptly issue a plan to implement and enforce the laws and resolutions, allocate resources, prepare necessary conditions, continue to issue and implement specific plans to soon bring the policies and regulations in the laws and resolutions of the National Assembly into life, especially the new and specific policies and regulations, with effectiveness earlier than the general effectiveness of the laws. It is also necessary to expeditiously construct and issue the detailed documents and instructions for nearly 400 assigned contents in the laws and resolutions of the National Assembly.

The feasibility, consistency, and coherence with related legal documents should be ensured, avoiding overlaps, complications, or deviations in the organization of implementation.

The focus should be on strengthening administrative procedure reform, implementing decentralization and delegation of power in accordance with regulations, and preparing sufficient resources and conditions.

The dissemination and promotion of awareness of the policies and contents of the laws and resolutions and the detailed documents and instructions for implementation by the agencies, organizations, individuals, and the public and businesses need to be enhanced.

The synchronously implemented measures to improve the effectiveness and efficiency of law enforcement, tighten discipline, and enhance the responsibility of leaders and the proactive and active responsibility of the civil service need to be implemented.

Alongside that, a strong inspection and supervision should be conducted to prevent and promptly detect and handle negative behaviors, group interests, and local interests in the enforcement of laws.

Timely and effectively address the issues of evasion, avoidance, and irresponsibility of a number of officials and civil servants. Strengthening control to avoid creating processes, procedures, or permits that contradict the regulations.

Focus on organizing dialogues with businesses and the public, promptly removing difficulties and obstacles that arise during the organization of law enforcement.

Regarding the implementation of the Citizen Identity Card Law, Deputy Chairman of the National Assembly emphasized the urgent need to design and complete the identity card model, electronic identity cards, and related forms and certificates; solicit opinions from relevant agencies, organizations, and individuals as prescribed; consider investment in necessary machinery, equipment, and facilities, and organize training and operation of technical systems to issue identity cards, certificates, and electronic identity cards to timely implement when the law takes effect and regulations detail the assigned contents of the law.

For the implementation of the Land Law, expedite the construction and issuance of documents regulating the 104 assigned contents of the law by the Government, detailed regulations and guidelines by the Ministries. During the process of issuing the detailed documents and guidelines for the implementation of the Land Law, the Government should fully consider the opinions of the Standing Committee of the National Assembly regarding some contents mentioned in Report No. 678/BC-UBTVQH15 dated November 2, 2023, and Report No. 724/BC-UBTVQH15 dated January 14, 2024.

Promptly review, amend, and supplement other documents under the Land Law related to ensure consistency with the Land Law in 2024 and 8 amended and supplemented laws in Section 1 of Chapter XVI of the Land Law in 2024.

Simultaneously, expeditiously construct and issue decrees, decisions, and circulars detailing and instructing the implementation of the Housing Law, Real Estate Business Law, ensuring compliance with the law’s regulations and consistency between the detailed regulations.

For the implementation of the Credit Institutions Law, expedite the construction and issuance of documents regarding the 19 assigned contents regulated by the Government, 1 assigned content regulated by the Prime Minister, and 82 assigned contents regulated by the Governor of the State Bank.

The National Assembly, its agencies, the National Assembly Delegation, the People’s Council, the Permanent People’s Council, deputies at all levels, the Vietnam Fatherland Front and its member organizations, based on their respective functions, tasks, scope, and areas, need to proactively study, plan, and monitor the enforcement of the laws and resolutions of the National Assembly…
