Condos Must “Fight Back” to Avoid Being Named on the List of Violating Fire Safety Regulations

The developer of apartment building No. 22B, Lane 236/17 Khuong Dinh (Ha Dinh, Thanh Xuan district, Hanoi) has caused a stir due to a structural issue in the support column on the ground floor, forcing all residents to evacuate urgently. Not only does this violate the fire prevention and control regulations in this area, but it also violates the regulations in a series of other mini apartment buildings.

Violation of fire protection regulations

In relation to the mini apartment building (CCMN) at 22B, alley 236/17 Khuong Dinh (Ha Dinh, Thanh Xuan), which has cracked columns resulting in the urgent evacuation of all residents, it has been found that this construction violates the regulations on Fire Prevention and Fighting (PCCC).

Specifically, at the beginning of February, the Thanh Xuan district police publicly announced a list of 90 residential construction projects (CCMN) that still exist and violate the PCCC regulations. Notably, this list includes many projects named Nghiem Quang Minh – the owner of CCMN that caught fire on Khuong Ha street, resulting in the death of 56 people.

Also here, the Thanh Xuan district police pointed out that the CCMN at 22B alley 236/17 Khuong Dinh, invested by Nghiem Manh Tien, has the following violations regarding PCCC: Supplementing fire prevention measures in the technical axis vertically and horizontally at each floor with non-combustible materials (mortar, concrete,…);

Supplementing iron stairs outside the building from the rooftop to the ground floor, adding rope ladders at the position of balconies or open windows of each apartment, adding an exit to the rooftop; Providing a contingency lighting system, emergency exit indicators, fire pumps.

CCMN at 22B alley 236/17 Khuong Dinh (Ha Dinh, Thanh Xuan) with cracked columns resulting in the urgent displacement of all residents has recently been named by the Thanh Xuan district police for violating the PCCC regulations.

Previously, speaking with Tien Phong, Nguyen Hong Phong – Head of Management Board of CCMN 22B said: “From the 30th day of Tet Nguyen Dan (February 9), after discovering the cracked columns, we have coordinated with the local authorities and the party responsible for handling the incident to temporarily reinforce the 1st floor to support the building. However, in order to find a solution for repair and ensure the long-term safety of the building, we need to temporarily evacuate all residents from the building.”

According to Phong, from the night of February 23 to February 24, the Management Board of the building has coordinated with the local authorities to safely evacuate 57 households from the building and arrange temporary accommodations for them, ensuring that the residents are not left homeless.

“We hope that the local authorities can support and cooperate with us to provide reassurances for the residents and allow them to access their homes to retrieve personal belongings as many households are currently facing difficulties. At the same time, we also hope that the local authorities will approve the repair solution proposed by the construction unit to ensure a suitable living environment for the residents,” Phong said.

The investor of CCMN 22B at alley 236/17 Khuong Dinh will bear full responsibility and the cost of repairing the cracked columns.

According to the minutes of the meeting between residents and the investor held on February 22, the investor and the households have agreed on the solution to address the cracked column incident, which is that the investor will bear full responsibility and cost of repairing the damages.

At the same time, the investor will also appoint a construction supervisor for 30 days. If after 30 days, the incident is not completely resolved, then the construction unit will be penalized, involving the households in the CCMN project.

The investor of several mini apartment buildings that violate fire protection regulations

Notably, according to the list published by the Thanh Xuan district police, at alley 236 Khuong Dinh, the investor of CCMN 22B at alley 236/17 is Nguyen Manh Tien, who is also the investor of mini apartment building number 6A at alley 236/32 Khuong Dinh that violates the PCCC regulations such as: Fire prevention measures in the technical axis vertically and horizontally with non-combustible materials (mortar, concrete); Building walls, fireproof doors dividing the parking area and the lobby area of the stairways; Not equipped with an automatic fire alarm system, an automatic fire fighting system for the entire project; Not supplemented with iron stairs; Not equipped with emergency exit signs, emergency lighting.

In addition to the mentioned projects, Nguyen Manh Tien is also the investor of 19 other CCMN projects that violate the PCCC regulations in Thanh Xuan district such as: CCMN number 4 at alley 358/55 Bui Xuong Trach, Khuong Dinh; CCMN number 76 at alley 358 Bui Xuong Trach; CCMN number 10B/320/5 Khuong Dinh, Ha Dinh;

CCMN number 166+168 at Khuong Dinh street, Ha Dinh (Thanh Xuan, Hanoi) invested by Nguyen Manh Tien violates the PCCC regulations. It is known that this CCMN building is 10 floors high, divided into hundreds of apartments with an area ranging from 20 – 50 m2.

Especially, CCMN number 315 Vu Tong Phan, Khuong Dinh, which is invested by Tien, caught fire in early March 2023, causing more than 170 people living in the building to panic and escape at night.

It is known that CCMN 315 Vu Tong Phan has been built for a long time with the function of a mixed-use building. When it was completed, the investor sold each apartment unit to those in need, however, the mezzanine level was still managed by the investor. At the time of the fire, the mezzanine level was rented out for food and beverage business despite strong opposition from more than 170 residents who believed that this was not in compliance with the PCCC regulations.

CCMN number 315 Vu Tong Phan, Khuong Dinh invested by Nguyen Manh Tien previously caught fire and has recently been named for violating the PCCC regulations.

During Tet holiday 2024, residents of mini apartment building 22B in alley 236/17 Khuong Dinh discovered that the two reinforced concrete columns that support the building on the 1st floor had large cracks running horizontally and vertically from the base of the columns to the ceiling of the building.

Despite concerns, 57 households continued to live normally as it was Tet holiday 2024 and they had nowhere to move. Upon receiving information about the signs of the building at 22B, leaders of Thanh Xuan district and the Ha Dinh commune People’s Committee sent a team of specialized personnel to the scene to inspect and assess the situation.

Subsequently, the Management Board of the mini apartment building, in coordination with the functional forces, carried out temporary reinforcement of the 1st floor to support the building.
