How is public housing managed and utilized as an asset?

The Ministry of Construction has proposed general regulations on the management and use of public housing properties in the draft Decree detailing and guiding the implementation of certain provisions of the Housing Law.

Management of public property residential units, responsibilities of management agencies for public property residential units

According to the draft, the management agency for old public property residential units is representative of the house owner as regulated in Article 14 of the Housing Law. They are responsible for managing the use of residential units, including:

– For the ministries, central agencies that are assigned the function of managing residential units by the ministries, central agencies;

– For localities, the management agency for residential units at the provincial level (Department of Construction);

– For educational institutions that are assigned the management of student dormitories, which were built before the effective enforcement of the Housing Law 2005, the educational institutions themselves will be responsible for the management.

The management agency for public property residential units is responsible for reviewing, collating, and classifying the residential units that are assigned for management; receiving self-managed residential units transferred by central agencies according to the regulations of this Law; preparing maintenance plans, renovation plans, or reconstruction plans for residential units and submitting them to the representational agencies for consideration and decision-making or deciding maintenance plans if they are assigned by the representational agencies for implementation.

Preparing, archiving residential unit records and delivering 01 set of completion records (for newly constructed cases) or redrawn records (for old residential units as regulated by the Housing Law) to the management unit of the residential units; reporting to the representational agencies for their decision-making on the contents specified in Clause 1, Article 14 of the Housing Law; signing contracts for sales, leases, or purchase of the managed residential units.

The management agency for public property residential units is responsible for inspecting and processing violations within its jurisdiction or recommending competent agencies to process violations related to the management and use of residential units under state ownership.

Management of revenues from leasing and selling public property residential units

The revenues from leasing and selling public property residential units are used to maintain and develop the fund of public property residential units according to the following regulations:

– The revenue from leasing residential units must be used for the purpose of maintenance and management of the state-owned residential units that are being leased;

– After deducting the costs of organizing the sale of residential units, the seller must remit the remaining amount to the state budget according to the current budget allocation level, except for the old residential units under the management of the Ministry of Defense, which will be used for reinvestment in the construction of social housing projects owned by the state in the area.

– For old public property residential units under the management of the Ministry of Defense and directly sold to the current renters, the amount must be remitted to the account managed by the Ministry of Defense for reinvestment in the construction of social housing for the subjects specified in Clause 7, Article 74 of the Housing Law. The Ministry of Defense is responsible for obtaining the unified opinion of the Ministry of Construction on the use of this funding and the construction of housing before implementing the construction of residential units. After completing the construction of residential units, the Ministry of Defense is responsible for reporting to the Ministry of Construction for consolidation and reporting to the Prime Minister.

The Ministry of Finance is in charge and coordinates with the Ministry of Construction in guiding the specific use of the revenue from leasing residential units for maintenance and management of leased residential units; guiding the costs of organizing the sale of public property residential units according to regulations.
