The construction of Software Park No. 2 project was commenced in October 2020, consisting of a 20-storey high-rise office building; an 8-storey ICT1 office building and headquarters; an office building; and an 8-storey ICT2 building, along with internal transportation system, lush greenery, and synchronized technical infrastructure system… After multiple attempts to attract investment and unsuccessful auctions, the city of Da Nang decided to invest nearly 1,000 billion VND from the city’s budget to construct it. Therefore, Software Park No. 2 project is a public asset.

Meanwhile, the regulations on the management of public infrastructure assets in the field of information technology have not been issued by the Government. This is the main obstacle that has resulted in the completion of the rough part of Software Park No. 2 without being put into use.
Since 2022, the city of Da Nang has repeatedly proposed to the Prime Minister regarding this project. On March 21, 2023, the Prime Minister allowed Da Nang to add this content in Decree 144/2016. The Ministry of Finance has also twice sought opinions from relevant ministries and agencies. Da Nang has also submitted explanatory documents and proposed recommendations to the Ministry of Finance regarding the management and operation mechanisms of this project.
Recently, on February 1, 2024, the Government issued Decree No. 09 amending and supplementing certain provisions of Decree No. 144 of the Government which regulates specific mechanisms for investment, finance, budget, and management levels for Da Nang city.
Accordingly, the Concentrated Information Technology Park is managed by the city of Da Nang People’s Committee. The city’s People’s Committee invests according to the regulations of the state budget law, the law on public investment as the infrastructure asset of information technology. Da Nang People’s Council considers the decision to invest in upgrading, expanding, and developing the infrastructure assets of information technology for the Concentrated Information Technology Park from the city’s budget.

The new decree of the Government also stipulates that the management and operation of the Concentrated Information Technology Park must ensure its assigned purposes, be publicly and transparently invested in, effectively supervised, inspected, and audited according to the law. Any violation of the law regarding the management, operation, and use of assets must be promptly detected and strictly handled according to the law.
The assigned entity for the Concentrated Information Technology Park is a public non-business unit of the Da Nang People’s Committee.
The organization of the operation of the Concentrated Information Technology Park must be formulated into a plan and approved by the city’s People’s Committee. Based on the approved plan, the management unit of the Concentrated Information Technology Park organizes implementation according to regulations.
The selection of entities to be provided with infrastructure and services in the Concentrated Information Technology Park is carried out through auctions. The auctioned entity must meet the requirements prescribed… The management unit of the Concentrated Information Technology Park is responsible for monitoring the auction process and fully implementing the rights and duties of the person whose assets are auctioned according to the regulations of the law on auctioning assets…
Regarding the management and use of the amount collected from asset exploitation, the new decree of the Government requires the management unit of the Concentrated Information Technology Park to submit the entire amount collected from exploitation into the state budget… The city’s People’s Council regulates the content and amount of expenses for the management unit of the Concentrated Information Technology Park.
In case there is no entity proposing the need to exploit the Concentrated Information Technology Park or the exploitation is ineffective, the management unit must identify the reasons, propose solutions, report to the professional agency for consideration and decision by the city’s People’s Committee or report to the competent authority for consideration and decision.
