Companies Collude to Facilitate Truong My Lan’s Wrongdoings

According to the indictment, there are 5 appraisal companies that artificially inflated the value of assets, enabling Truong My Lan to withdraw money and causing significant financial losses related to the misconduct that occurred at Van Thinh Phat Corporation.

On the afternoon of March 6, the trial session of defendant Truong My Lan (68 years old, former Chairman of the Board of Directors of Van Thinh Phat Group), along with 85 accomplices involved in the misconduct at Van Thinh Phat Group, Saigon Commercial Joint Stock Bank (SCB), and related units were held. This is part of the announcement of the indictment by the prosecuting agency.

Prosecutors continue to announce the indictment on the second working day of the trial.

In the misconduct section regarding the appraisal companies, the representative of the controlling agency stated that the accused Tran Van Nhi (48 years old, from Binh Dinh province, former Deputy Director of ATC Audit and Appraisal Company, a property appraisal broker for SCB) had coordinated with Tran Thi My Dung (39 years old, from Kien Giang province, former Deputy General Director of SCB), and Bui Ngoc Son (35 years old, from Ninh Thuan province, former Deputy Director of SCB Appraisal Department) to contact and agree on issuing 2 fraudulent appraisal certificates, backdating the dates, inflating the asset values so that SCB could include them in legitimate mortgage files, loan files, and disburse funds for 65 loans and withdrawals for Truong My Lan to use.

The total outstanding loan balance as of October 17, 2022, is over VND 127,000 trillion. Tran Van Nhi’s actions have caused damages to SCB in the amount of over VND 110,000 trillion.

The accused Tran Thi Kim Ngan agreed and coordinated with Tran Van Nhi to issue fraudulent appraisal certificates, increase the asset values as requested by SCB in order to include them in legitimate mortgage files and loan files.

From August 2020 to December 2020, Tran Thi Kim Ngan signed the issuance of 2 fraudulent appraisal certificates, inflating the asset values and backdating the issuance dates to allow SCB to include them in legitimate mortgage files, loan files, and disburse funds for 65 customers.

The total outstanding loan balance for these loans as of October 17, 2022, is over VND 127,000 trillion. Tran Thi Kim Ngan’s actions have caused damages to SCB in the amount of over VND 110,000 trillion.

The accused Tran Tuan Hai (34 years old, from Tien Giang province, former appraiser at Thiên Phú Appraisal Company) carried out the instructions of Tran Thi Kim Ngan. From August 2020 to December 2020, he signed the issuance of 2 fraudulent appraisal certificates, inflated the asset values, and backdated the issuance dates to allow SCB to include them in legitimate mortgage files, loan files, and disburse funds for 65 customers.

The total outstanding loan balance for these loans as of October 17, 2022, is over VND 127,000 trillion. Tran Tuan Hai’s actions have caused damages to SCB in the amount of VND 110,000 trillion.

The indictment shows that the accused Ho Binh Minh (39 years old, from Da Nang province, former Deputy General Director of MHD Appraisal Company) agreed and coordinated with Tran Thi My Dung and Bui Ngoc Son for MHD Company to issue appraisal certificates, inflate the asset values, and backdate the issuance dates for SCB to include them in legitimate mortgage files.

As of October 17, 2022, the false loans used for withdrawals by Truong My Lan mentioned above still have an outstanding balance of over VND 10,000 trillion.

In addition, Ho Binh Minh also drafted reports and fraudulent appraisal certificates to help Tâm Nhìn Mới Company issue appraisal certificates, allowing Truong My Lan and accomplices to have legitimate loan files for 3 customers, with an outstanding loan balance as of October 17, 2022, of VND 15,000 trillion. Ho Binh Minh’s actions have caused damages to SCB in the amount of over 11,000 trillion.

The accused Le Huy Khanh (53 years old, residing in Hanoi, former Director of Tâm Nhìn Mới Appraisal Company) agreed and coordinated with Ho Binh Minh to receive and sign the issuance of 2 appraisal certificates, inflate the asset values, and backdate the issuance dates for SCB to use, causing significant damages to SCB in the amount of over 11,000 trillion.

The accused Do Xuan Nam (47 years old, from Hai Phong city, former Deputy General Director and appraiser at DATC Real Estate Consulting and Service Company) agreed and coordinated with Nguyen Phuong Hong and Le Anh Phuong to sign the issuance of appraisal certificates with inflated asset values and backdating the issuance dates for SCB to include them in legitimate loan files.

As of October 17, 2022, the false loans used for withdrawals by Truong My Lan mentioned above still have an outstanding balance of over VND 4,000 trillion and are unlikely to be recovered. Do Xuan Nam’s actions have caused damages to SCB in the amount of over 4,200 trillion.

The accused Le Kieu Trang (37 years old, from Tien Giang province, former Deputy General Director of Exim Appraisal Company) took advantage of her position as Deputy Director from 2017 to 2019, directly appraised and signed the issuance of 17 fraudulent appraisal certificates with inflated asset values for Exim Company, allowing SCB to include them in legitimate mortgage files and loan files for 11 customers, with an outstanding loan balance as of October 17, 2022, of over VND 1,550 trillion, causing damages to SCB in the amount of 984 trillion.
